There were two charges against Dr Mulvey. The first was that, between May and October 2018, she failed to provide the clinical history for an English Cocker Spaniel named Henry to the Tremain Veterinary Group, despite numerous requests. Also, that between August 2018 and October 2018, she failed to respond adequately or at all to Henry’s owner's requests for information, particularly his clinical records and details of insurance claims made for Henry by her practice.
The second charge was that in January/February 2019, she failed to respond to reasonable requests from the RCVS, particularly in relation to her treatment of Henry, her continuing professional development (CPD) and the status of her Professional Indemnity Insurance.
At the beginning of the hearing, Dr Mulvey admitted the facts and conduct alleged in the charges and also admitted that when her conduct was considered cumulatively, she was guilty of disgraceful conduct in a professional respect.
The Committee, having considered the evidence provided by the College and Dr Mulvey’s admissions found all the facts and conduct to be proved.
The Committee also concluded that Dr Mulvey's failure to respond to Henry's owners and to the College amounted to disgraceful conduct both when considered individually and cumulatively.
In respect of the first charge, the Committee decided that Dr Mulvey had breached the Code of Professional Conduct for Veterinary Surgeons by failing to provide clinical records or details of insurance claims.
This was an administrative part of the function of a veterinary surgeon’s role and that failure to provide clients with such information was unacceptable and fell far short of acceptable professional standards. The Committee noted that Dr Mulvey’s failure to provide details of insurance claims had occurred because she had not made those claims, despite offering to do so.
With regard to the second charge, the Committee concluded that Dr Mulvey’s failure to respond to five requests from the College for information about Henry was unacceptable.
The Committee also considered that the omissions took place in the context of Dr Mulvey’s previous Disciplinary Committee hearing in April 2018 during which she agreed to a number of undertakings including supervision on her professional practice by an appointed supervisor. It therefore decided that her failure to provide evidence of her CPD and Professional Indemnity Insurance to the College each individually amounted disgraceful conduct in a professional respect.
The Committee then went on to consider the sanction for Dr Mulvey in relation to the both charges that it had found proved and also in respect of the charges it had found proved at its earlier hearing on 26 April 2018 for which sanction had been postponed for a period of 1 year to enable Dr Mulvey to comply with undertakings she gave to the Committee to ensure that her practice met RCVS Core Standards by May 2019.
The Committee heard from Mr Stuart King MRCVS who had been appointed to act as a Workplace Supervisor for Dr Mulvey during the period of her Undertakings. Mr King provided the Committee with a report upon the extent to which Dr Mulvey had complied with the terms of her undertakings including the extent which she had implemented Dr King’s numerous recommendations.
The Committee also heard from Dr Byrne MRCVS an inspector for the RCVS’s voluntary Practice Standards Scheme that Dr Mulvey’s practice, when inspected by him in early April 2019, had not met RCVS PSS Core standards in a number of areas.
The Committee heard from Dr Mulvey and her Counsel that she accepted that she had not met RCVS Core standards as she had undertaken to do.
In reaching its decision as to sanction for all the matters, the Committee took into account that Dr Mulvey’s misconduct overall was serious because it was repeated.
The Committee also considered aggravating and mitigating factors.
Aggravating factors included the fact that the misconduct was sustained or repeated over a period of time (in relation to charge 1 for a period of approximately 4 months and in relation to charge 2 for approximately 6 weeks).
Other aggravating factors include the fact that Dr Mulvey’s conduct contravened advice issued by the Professional Conduct Department in letters sent to her, and that she had wilfully disregarded the role of the RCVS and the systems that regulate the veterinary profession.
Mitigating factors included that: there was no harm to any animal; there was no financial gain for Dr Mulvey or any other party; there was no ulterior motive behind Dr Mulvey’s conduct; and that Dr Mulvey had in fact both completed her minimum CPD requirement and secured Professional Indemnity Insurance, demonstrating that she had not attempted to hide such information from the College.
It also took into account that Dr Mulvey, prior to the first Disciplinary Committee’s hearing in 2018, worked without any previous disciplinary findings against her from 1976 to 2018. The Committee also noted that she had made efforts to comply with some of the undertakings.
Mr Ian Green, Chair of the DC and speaking on behalf of the Disciplinary Committee, said: "The Committee considered that a warning or reprimand was not an appropriate sanction that would meet the public interest. Instead, the Committee decided that a suspension order for a period of six months would allow Dr Mulvey sufficient time to focus on ensuring her practice met the Core Standards set out in the Practice Standards Scheme, without the daily demands of practising as a veterinary surgeon, and was a proportionate and sufficient sanction to meet the public interest.
"The Committee was satisfied that a period of six months met the public interest as it was sanctioning Dr Mulvey for two sets of similar misconduct which we had determined overall as serious. The Committee also believed that during these six months Dr Mulvey could reflect and reorganise her practice, and there would be little risk to animals and the public in her returning to practice."
Dr Mulvey has 28 days from being informed of the Committee’s decision to lodge an appeal with the Privy Council.
The practice says that because thiamine deficiency in cats is generally rare, the number of recent cases seen in the UK has been a cause for concern amongst veterinary surgeons.
Symptoms may include severe weight loss or anorexia, vomiting, impaired vision, dilated pupils, tremors and seizures. Prompt treatment is needed, usually in the form of thiamine injections, an oral supplement and an immediate change of food as a precaution.
Laurent Garosi RCVS & European Veterinary Specialist in Neurology at Davies Veterinary Specialists said: "In 20 years I have only seen a handful of cases. My concern is that there may be many more cats out there in need of a diagnosis which is why we are building awareness and supporting our referring vets in the diagnosis of this condition."

What are the signs of thiamine deficiency in cats? Initially most cats will show anorexia and some degree of vomiting preceding neurological signs which include fairly rapid onset of impaired vision, dilated pupils, ataxia, vestibular signs, tremors and seizures.
How do you diagnose thiamine deficiency? It is based on a combination of factors: clinical presentation, MRI findings, which are fairly typical (although not pathognomonic) and response to thiamine supplementation. Absolute confirmation is technically difficult and not widely available: direct measurement of thiamine in the blood may not reflect deficiency, as this is not a good reflection of tissue concentration of Thiamine. Indirect methods are functional tests looking at effects of thiamine or lack of it: demonstration of reduced transketolase activity in red blood cells which is not readily available for most veterinary practices, or other indirect methods such measuring abnormal metabolites such as organic acids in the urine.
What are the causes of thiamine deficiency in dogs and cats? There are three main causes: 1) inability to absorb thiamine due to gastro-intestinal disease, 2) inability to process thiamine due to liver disease and 3) decreased level of thiamine in food. The latter can be caused by the heating process used for food preparation (thiamine is destroyed by heat), addition of sulphur dioxide or sulphite preservatives to meat which inactivate thiamine and feeding food rich in thiaminase activity such as some raw fish. Therefore all-raw fish diet in cats can be a cause of thiamine deficiency.
What to do if you suspect you have a cat with thiamine deficiency and whose diet consists of a product being recalled? Unless the cat is showing neurological signs, the first step is to stop the diet and switch to another diet not listed in the recall. Thiamine supplementation (intramuscular injection) is advised in the first instance in a case with compatible neurological signs. Other causes for the neurological signs must be considered in the case of failing to respond to Thiamine injections within 24-48 hours.

Virbac Animal Health is launching an initiative to highlight the prevalence of Benign Prostatic Hyperplasia (BPH), a condition suffered by more than 80% of entire male dogs over the age of five1.
The campaign will take place during November - or 'Movember' as it's called by the thousands of men who grow moustaches during the month to raise funds for male prostate and testicular cancer. Virbac says it hopes the campaign will remind dog owners that men are not the only ones to suffer from prostate disorders.
As part of the campaign, the company will be providing participating practices with promotional materials including free dog leads, owner educational and display materials, a press release for local media and practice educational materials.
Chris Geddes MRCVS, Virbac Product Manager, said: "It's estimated that 20% of the country's eight million dogs remain uncastrated throughout their lives. As dogs age, their prostates enlarge, eventually causing symptoms including constipation, lameness and difficulties in urination. However, most of the time clinical signs are absent or vague so diagnosing BPH can be a challenge."
According to Virbac, the traditional rectal examination technique can be an ordeal for both dog and clinician. It's also sometimes inaccurate even in experienced hands and is impossible in very small or large breeds. As a solution, the company has recently introduced Odelis CPSE, the first ELISA test to screen for, diagnose and monitor BPH, available from three UK diagnostic laboratories. The company says it's a cost-effective, precise and reliable alternative to rectal palpation. Virbac also offers Ypozane, a simple tablet treatment for BPH, which takes effect within a week and lasts for six months.
Chris added: "BPH is a serious threat to the health of entire dogs as they get older but owners are often unaware of the potentially serious health problems it can cause if left untreated.
"We hope that, by running our Prostate Awareness Campaign at a time when the media spotlight is already on the dangers of prostate cancer in men, we can help spread the message that owners should also be monitoring older dogs for signs of prostate disease.

The new SAMSoc section of VetSurgeon contains a host of features to facilitate the sharing of ideas, experiences and knowledge amongst the society's members. There's a photo and video sharing gallery in which to share and discuss interesting cases. There's a dedicated forum to debate current issues and ask SAMSoc advice about difficult cases. Dechra Veterinary Products has launched Osphos, an intramuscular clodronic acid injection for the control of clinical signs associated with the bone resorptive processes of navicular syndrome in horses, the only such licensed product in the UK.
Dechra says it expects Osphos to change the way chronic lameness caused by navicular syndrome is tackled by equine vets.
According to the company, clinical trials of Osphos showed 74.7% of horses experienced improvement by at least one lameness grade at 56 days post treatment.
Dechra brand manager Emma Jennings said: "Osphos intramuscular injection contains the bisphosphonate clodronic acid which inhibits resorption in the navicular bone by binding to hydroxyapatite crystals and by direct cellular effects on osteoclasts.
"We are delighted with the results of the trials, which proved that Osphos is effective at 6 months post-treatment. We're looking forward to being able to support equine vets, vet nurses and practices by providing an intramuscular Clodronic acid injection for horses."
Dechra also says studies showed that mild transient colic was seen following just 1.6 per cent of treatments.
Osphos 60 mg/ml solution for injection for horses is available from September 2014.

The responsible use of antibiotics termed critically important is an important strand in the UK policy to fight antibiotic resistance development.
However, NOAH says there is much confusion about which antibiotics should be considered within this group, with different organisations referring to different classes.
Donal Murphy, Head of Technical and Regulatory Affairs at NOAH said: "NOAH believes the classification and use of antibiotics in veterinary medicine should be driven and guided by the regulators, who are independent and make science based decisions and recommendations.
"Of course, all classes of antibiotics, whether critically important or not, should be used responsibly and guided by the principle outlined by the Responsible Use of Medicines in Agriculture Alliance (RUMA) who state they should be used 'as little as possible but as much as necessary'. The use of these important products in this manner can ensure that the availability and efficacy of antibiotics can be maintained to ensure animal health and welfare in the future."

Born in the UK, and raised in Trinidad & Tobago in the West Indies from the age of two, Mandisa moved back to the UK aged 18 to study for a BSc in Biological and Medicinal Chemistry at the University of Exeter. She then gained her veterinary degree from the Royal (Dick) School of Veterinary Studies at the University of Edinburgh in 2008.
Since graduating, her interests have lain in small animal practice and emergency and critical care, and she has worked as a veterinary surgeon in a number of practices in the West Midlands. She currently works for Medivet in the Staffordshire town of Newcastle-under-Lyme and lives in Stoke-on-Trent. She is a published author, having been the researcher on a paper about genomic variations in Mycobacterium published in BMC Microbiology.

Petplan has launched a new look policy range to give pet owners more comprehensive cover and make it easier for them to understand the types of cover available.
Simon Masding, Petplan's Head of Sales and Partnerships said the refreshed policies will not only benefit the pet and their owner but the changes will also allow veterinary staff to explain the policies with a lot more clarity: "Since Petplan started 35 years ago the pet insurance market and vet industry has changed significantly, especially in the last few years. There are now over 250 policies in the market with varying benefits and levels of cover, which often confuses customers to a point where they think they're getting lifetime cover but they're instead trapped with a restrictive policy.

Apparently, the feedback showed that Petplan needed to communicate its range of policies more clearly, to shift away from the confusion created by other brands and meet the changing demands of the vet industry and pet owners better.
For this reason, Petplan says it has simplified its policy range, adding and increasing each policy's benefits, making a 12 month policy available for practices to offer, and developing easy-to-understand policy names.

Dechra Veterinary Products has launched an online CPD programme to help the veterinary profession diagnose, manage and treat dogs suffering from Hyperadrenocorticism (Cushing's syndrome).
The new Canine Hyperadrenocorticism CPD module has been designed to help vets by providing them with a comprehensive overview of the condition, which they can study in their own time and at their own pace. According to Dechra, it aims to take the guesswork out of managing this complex condition and to support vets in improving the quality of life of Cushing's syndrome patients.
It is the latest online CPD course to be offered through The Dechra Academy, a resource which offers a range of learning and support content and client materials. Accounting for six hours' CPD, the Cushing's syndrome online module complements a CPD road show on the disease recently completed by Dechra around the UK. Over 350 vets attended the sessions and further meetings are scheduled for later in 2011.

The Forestry Commission, together with other agencies and landowners, is stepping up efforts to find out why some dogs have fallen ill while on countryside walks.
Over 50 cases of so called Seasonal Canine Illness (SCI) occurred during the autumn of 2009 and 2010 in Nottinghamshire, Lincolnshire, East Anglia and Warwickshire, although there have been reports from further afield.
Symptoms include severe vomiting, diarrhoea, shaking / trembling and high temperature, and have generally been displayed by animals within 24 hours of walking in the countryside, especially in woodlands. A small number of dogs have died. The cause of Seasonal Canine Illness remains unknown.
Jo Atkinson, from the Forestry Commission, said: "Although no cases have yet been reported this year, we are working with our many partners to get a clearer picture of the distribution and reasons behind this upsetting sickness. Both dog owners and vets can play their part too in helping protect cherished pets."

The epidemic of respiratory disease in early 2010 was characterised by coughing and nasal discharge.
The disease spread through the population of 77,000 Icelandic horses within weeks, leading to a self-imposed ban on their export and significant economic cost to the country.
Initially, due to the speed at which the disease had spread, a viral cause was suspected. However, investigations by researchers at the University of Iceland showed that only Streptococcus zooepidemicus was consistently recovered from coughing horses and rare fatal cases of infection. However, this bacterium is also often found in healthy horses.
The AHT and the Wellcome Trust Sanger Institute were brought in to investigate. Dr Simon Harris from the Wellcome Trust Sanger Institute said: "To identify the culprit, we sequenced the DNA from 257 samples of bacteria from diseased animals and people. This showed that one specific strain of S. zooepidemicus, called ST209, was the likely culprit, and we also found this strain in a human case of blood poisoning. This study highlights, for the first time, how DNA sequencing can be used to identify endemic strains of bacteria and distinguish them from the cause of an epidemic infection."
Iceland is free of all major equine infectious diseases thanks to the ban on the importation of horses into the country in 1882. Consequently, Icelandic horses are particularly susceptible to any new bacteria or virus that crosses the border, and so strict biosecurity regulations are in place to help protect them.
Dr. Sigríður Björnsdóttir of the MAST Icelandic Food and Veterinary Authority, used information from owners and veterinary surgeons to build an epidemiological network. This enabled her to identify an equine rehabilitation centre where horses exercised in a water treadmill. The water treadmill is thought to have provided the perfect conditions for transmitting the disease as water was splashed up and ingested. Horses would complete their rehabilitation and return home, whilst incubating the disease, taking the infection with them.
The ST209 strain of S. zooepidemicus found in Iceland has also been recovered from a coughing horse in Sweden and an abdominal abscess in a Finnish horse trainer.
Dr Andrew Waller, Head of Bacteriology at the AHT, said: "There are a couple of theories as to how the strain entered Iceland. These bacteria are able to survive outside a horse for a week or so, which means the import of contaminated equipment or clothing is the most likely route by which ST209 entered Iceland. However, this particular strain could have even infected a human who travelled to Iceland, before spreading the strain back to a horse and triggering the epidemic.
"We are delighted to have helped uncover the likely identity of the cause of this epidemic. Our investigation highlights the ability of S. zooepidemicus strains to cause disease in animals and people. We found evidence that even endemic strains of S. zooepidemicus were likely causing cases of respiratory disease in Icelandic horses, illustrating that this group of bacteria causes more clinical problems in horses than was previously thought. We hope that raising awareness of the cause of this epidemic, and the likely involvement of a water treadmill as a key factor in disease transmission, will encourage veterinarians around the world to improve disease control precautions preventing future epidemics."

The study1 was led by the RVC’s VetCompass programme and included 22,333 dogs whose health was followed for a year, during which 1,580 were recorded by the vet as overweight; roughly 1 in 14.
The authors point out that this figure is probably just the tip of the iceberg, because not every overweight pet will receive veterinary attention.
The study also found that certain breeds were especially prone to weight gain, including Pugs, Beagles, Golden Retrievers and English Springer Spaniels.
As well as showing that specific breeds were at differing risk, the study also highlighted that being neutered and middle-aged were additionally associated with increasing chances of dogs being overweight.

Owners are encouraged to discuss their dog’s weight and lifestyle on every visit to their veterinary practice. This is of particular importance in the high-risk dogs identified in this study such as Pugs, Beagles, neutered and middle-aged dogs.
Camilla Pegram, VetCompass Epidemiologist at the RVC, and author of the paper, said: "This study has used the power of “big data” to robustly address the risk factors for obesity in dogs. Pugs, Beagles and Golden Retrievers were at greatest risk of obesity compared with crossbreeds.
"As well as genetics, management style could in part drive these breed predispositions. Whilst veterinary professionals and owners should focus efforts on obesity prevention strategies in all dogs, those identified at high-risk, such as Pugs, Beagles and Golden Retrievers, may need a more targeted approach."
Dr Eleanor Raffan, Associate Lecturer in Systems Physiology, at the University of Cambridge, and co-author of the paper, said:
“Where breed increases risk of a problem, it means genes are likely to be at least in part to blame and our previous work suggests that genetics drives a high appetite in some breeds. The bad news is that owners of food-obsessed dogs have to work much harder to keep their dogs at a healthy weight – the good news is that it can be done.”
The RCVS is seeking feedback on a new draft Code of Professional Conduct.
The new Code, which would replace the existing RCVS Guide to Professional Conduct for Veterinary Surgeons, has been produced by a Working Party set up by the RCVS Advisory Committee to review the Guides for both veterinary surgeons and veterinary nurses.
According to the College, the purpose of the review, which last took place over a decade ago, is to ensure guidance to the profession and the public is clear. For example, using consistent language to distinguish between what must be done and what is advised.
The RCVS says the new Code is a short, principles-based document using the Federation of Veterinarians of Europe's Code of Conduct as the starting point. It will be supported by additional advice on specific areas of veterinary practice or issues, for example, clinical governance. It also includes:
Clare Tapsfield-Wright, Chairman of the Guides Review Working Party said: "Over the decade or so since it was last reviewed, not only has the Guide become unwieldy in places, but the way that regulators in general publish professional conduct rules has changed. Our draft new Code aims to clarify matters and bring us into line with best practice elsewhere.
"Animal owners are increasingly keen to understand the basis of what the veterinary profession considers to be good professional conduct. The new simplified Code should assist with this understanding."

A separate document is under development for veterinary nurses, which will share broadly similar underlying principles and will be the subject of its own consultation.
Norbrook Laboratories has launched Norfenicol Solution for Injection (florfenicol), a broad spectrum antibiotic licensed for the treatment of pneumonia in cattle and pigs.
Dr Barry McInerney, Norbrook's GB Veterinary Advisor said: "With many farmers preparing for winter housing, the launch of Norfenicol is timely as pneumonia represents the most common disease of housed cattle in the UK costing the agricultural industry an estimated £80m per year. Norfenicol is an easy to inject, cost effective treatment of pneumonia which kills bacteria quickly, and is available in a durable plastic bottle. Studies have shown florfenicol, the active ingredient in Norfenicol, to have a high bacteriological and clinical efficacy (100% and 96% respectively) against susceptible bacteria in the treatment of calf respiratory tract diseases."
Norfenicol is indicated for the treatment of bacterial respiratory disease in cattle associated with Mannheimia haemolytica, Pasteurella multocida, and Histophilus somniand for the treatment of acute outbreaks of respiratory disease caused by strains of Actinobacillus pleuropneumoniae, and Pasteurella multocida in swine.
Dr McInerney added: "NSAIDs have also been shown to be a beneficial ancillary therapy in treating bacterial pneumonia, to alleviate pain as well as to reduce inflammation and pyrexia. Norbrook has a range of NSAID products which are available as an adjunctive treatment for pneumonia in cattle, including Loxicom 20 mg/ml solution for injection for cattle, pigs and horses."

As part of the programme, BEVA is giving the coaches workshops, discussion forums and online toolkits to develop their mentoring skills. Having been trained by a specialist mentoring professional, the coaches are then paired with recent graduates to give them guidance and support during the foundation years of their careers.
The project, called 'Leg Up', has been driven by BEVA President Renate Weller, and is being trialled over the next 12 months before being rolled out more widely.
Renate said: "All professionals, but especially new graduates need support in navigating their journey through their chosen career.
"With the veterinary industry’s rapidly changing landscape and rising concern around wellbeing, consistent support and guidance have never been more relevant."
Coaching is open to BEVA concessionary members who have graduated within the past three years. They will be able to self-select a preferred coach on a first come, first served basis from the Leg Up section of the BEVA website.
Renated added: "To date access to targeted careers support has most often depended on where you work and who you know. We hope the scheme will encourage and support those entering the profession, giving them the opportunity to discuss their training, development, career progression and self-care with trained professionals who were once in their shoes."

Henry, who works at Crowshall Veterinary Services in Norfolk, graduated from the Royal Veterinary College in 2018.
He is the lead products export vet for Crowshall and was instrumental in the business’s preparation for Brexit.
He is also one of the founding ‘green champions’ at the practice, which has become the first specialist poultry practice to be accredited with Investors in the Environment.
The panel of seven judges from said that within just three years Henry has gained much experience, showing evidence that he has contributed to reduced antibiotic usage as well as improved biosecurity and improved bird welfare, health and production for his clients.
They said: “He has clearly shown he has worked with colleagues as a team, and has introduced new initiatives in his practice including improving mental health of staff and assisting in sustainability.”

Developed by Italian tech company, Otech Industry srl, the Onemytis 2 uniquely uses gas ionisation to vaporise tissue at lower temperatures and, claims Excel, with greater precision than is possible with conventional electrosurgery.
The knife works by a strong electromagnetic field through air. This releases plasma which vaporises tissue at a maximum operating temperature of 50°C (compared to more than 118°C in conventional electrosurgery).
During surgery, the electrode does not touch the patient. Plasma is formed when it is between 1 and 2 mm away from the patient, depending on the power setting. This means the surgeon does not apply any pressure when creating an incision, allowing greater precision.

West Sussex first opinion vet, Julian Hoad, Head of Crossways Veterinary Group, started using Onemytis last year for a range or procedures including laparoscopic surgery and the removal of masses, often without the need for a general anaesthetic.
Julian said: "I’ve used electrosurgery for 20 years and this is an order of magnitude better. It is more precise, more reliable and results in a much better healing surface."
"I recently removed an enlarged lymph node. The mass was around the mesenteric root. ECM of France, a specialist in veterinary ultrasound solutions, has launched VIRTUAL SCAN - an ultrasound scanner for pig farmers and veterinarians. ECM says the scanner offers an alternative to screenless A-Mode Doppler devices, cheaper ultrasound devices, which are often poor quality.
VIRTUAL SCAN weighs 450 grams. It is equipped with an internal five-hour battery and a 5MHz sector probe. ECM says the instrument is extremely easy to handle - all the user needs to do is switch it on and the hand-held instrument is instantly ready to perform an ultrasound on sows.
VIRTUAL SCAN is a compact device (11cm x 18.5cm x 4.5cm) and does not require an external cable. According to the company, it can be used in any livestock facility, even inside narrow, hard-to-reach stalls. The screen is positioned in such a way that the image is always visible.
Using ECM's scanner, pregnancy tests can be performed as early as 21 days after insemination, so it is possible to re-inseminate any unfertilised sow without wasting a costly additional cycle. The image is easy to interpret. After use, the VIRTUAL SCAN ultrasound instrument is easy to clean with a damp cloth or water.
ECM, which is headquartered in Angoulême (in south-western France), develops and manufactures specialist veterinary-science devices. The company also provides training in ultrasound techniques, the correct way to move the probe and how to interpret the ultrasound image.

This was the sixth time that Mr Warwick Seymour-Hamilton had applied for restoration after being removed from the Register in June 1994, the reasons for which related to the condition of his practice premises and his record-keeping following an inspection by the RCVS. His most recent restoration hearing took place in May 2017.
In his application Mr Seymour-Hamilton said that he wanted to be restored to the Register to aid his research into herbal medicines and, during the course of the hearing, he also challenged some of the evidence given to the Committee in the June 1994 hearing. In particular he challenged the assertion that his practice was open when it was inspected by the RCVS as, he submitted that, he had retired three weeks’ prior to the inspection due to ill-health.
Mr Seymour-Hamilton told the Committee that he did not wish to return to clinical practice but wished to restore his membership of the RCVS in order to prescribe his own herbal treatments and to obtain peer review that would allow his treatments to be licensed. Furthermore, he produced, during the hearing, a continuing professional development (CPD) record card in which he had logged 1,438 hours of CPD in 2017.
In considering his application for restoration the Committee dismissed his challenge to the details of his original hearing in June 1994.
Ms Judith Way, Chairing the Committee and speaking on its behalf, said: "The Committee has noted that this issue is ancient. It is not for this Committee to consider it. Moreover the finding of the Committee represents a determination which was not challenged by the applicant until one of the more recent restoration applications. He never appealed it. Nor did he attend at the original hearing. It acknowledges that the premises could well have been closed given their condition, but whether they were or not is not for it [the Committee] to decide. It is quite possible the applicant has persuaded himself of the position. This is not an issue which is a persuasive factor in this application."
Regarding Mr Seymour-Hamilton’s contention that he would use his RCVS registered status to further his research into herbal treatments Ms Way said: "The Committee accepted there were no direct public protection issues which caused it concern, although it did retain some anxiety that the applicant’s commitment to herbal medicine could govern the way in which he would wish to care for an animal. A more rounded veterinary approach, which involved a full evaluation of an animal’s condition, a coherent diagnosis and a subsequent discussion about treatment with the client is called for."
Turning to his CPD she added: "His CPD now has a bias for herbal medicine as does his extensive reading. The Committee was not satisfied that his skills are up-to-date and that he could practise veterinary medicine safely. The Committee was not satisfied that he would approach a sick animal with the full and rounded approach required of a veterinary surgeon. Nor did his confidence in this regard allay the concerns of the Committee. He expressed belief in himself on the basis of his practice which came to an end some 24 years ago."
The Committee did acknowledge that Mr Seymour-Hamilton’s removal from the Register had a considerable impact on him and that, not only is he ashamed of it, but he believes it is frustrating his ability to advance the cause of herbal medicine.
In conclusion, Ms Way said: "Taking all these matters into account, the Committee has concluded that the applicant has not satisfied it on all of the evidence that he is fit to be restored to the Register and so this application is refused."
The proposed framework has grown out of the VN Futures research project, run jointly with the BVNA, which identified developing a structured and rewarding career path for veterinary nurses as one of the key demands of the profession.
It has been developed by the VN Futures Post-Registration Development Group in conjunction with the RCVS Veterinary Nurses Education Committee and Veterinary Nurses Council.
The College says the proposed framework is designed to provide accessible, flexible and professionally relevant post-registration awards for veterinary nurses in order to provide an enhanced level of veterinary nursing practice, while also providing specific modules that veterinary nurses at all career levels can study independently for their continuing professional development (CPD).
Julie Dugmore, Director of Veterinary Nursing at the RCVS, said: "One of the strongest messages that came out of the research we conducted with the British Veterinary Nursing Association prior to the publication of the VN Futures Report was that there was a need for a more structured and rewarding career path for veterinary nurses.
"Throughout the VN Futures roadshow events nurses felt they were often entering a career cul-de-sac after a certain amount of time in practice and so the need for further post-registration qualifications which promote excellence and recognise advanced knowledge, skills, competency and experience in designated areas were strongly expressed.
"We have taken this feedback and developed it into a comprehensive framework for two defined post-registration qualifications and are very interested in hearing what both veterinary nurses and veterinary surgeons have to say about all aspects of what we are proposing.
"Once we have collated the responses, we will incorporate the feedback into the framework for further consideration by the relevant committees and VN Council. The eventual aim is that these qualifications will, once sufficiently bedded in, lead to the development of an Advanced Veterinary Nurse status so that members of the VN profession with the sufficient skills and experience will get the recognition they truly deserve."
The two new qualifications included in the framework are a Graduate Certificate in Advanced Veterinary Nursing and a Postgraduate Certificate in Advanced Veterinary Nursing. Details of the courses’ structure, candidate assessment criteria, accreditation standards, student support, candidate eligibility rules, the RCVS enrolment process and the procedures for certification will be set out in a framework document as part of the consultation process.
The document also includes a prospective list of designations for the two courses covering areas of advanced veterinary nursing knowledge such as wellness and preventative health; rehabilitation and physiotherapy; anaesthesia and analgesia; triage, critical care and emergency nursing; pharmacology; animal welfare; education and teaching; management and leadership; research; and, dentistry.
The consultation will be launched in early July with an email sent to all veterinary nurses and veterinary surgeons containing a link to the survey and asking for their views on the proposals. Details of the consultation, once launched, may also be found at www.rcvs.org.uk/consultations
