The RCVS has launched a new College honour, the RCVS Queen's Medal.
RCVS President Col Neil Smith said: "The Queen's Medal will be the most prestigious honour that the RCVS can bestow upon a veterinary surgeon and will be reserved for those whose distinguished careers and outstanding lifetime achievements deserve wider recognition."
The honour was created following a review of the RCVS honours system, which demonstrated the need for a new aspirational award.
The RCVS wrote to the Cabinet Office last year, together with letters of support from Peers and MPs, many of whom attended the reception, to request permission to name this new honour after Her Majesty the Queen.
Col Smith said: "We are honoured that Her Majesty has supported the proposal and allowed the College to name the award after her, and express our sincere thanks to those Parliamentarians who supported our endeavour."
The first RCVS Queen's Medal will be presented at RCVS Day in July 2014. The nomination form for the Queen's Medal can be found at www.rcvs.org.uk/Queensmedal.
Boehringer Ingelheim Vetmedica has extended its Metacam 0.5 mg/ml Oral Suspension for Cats range with the launch of a 30ml bottle size, which the company says will last the average 5 kg cat for two months.
According to Boehringer, the new 30ml bottle will offer owners a cost saving compared to purchasing two 15 ml bottles. In addition, it will provide greater prescription options for veterinary practices currently stocking 3ml and 15 ml bottles,,

Specifically, Ms Hodgkinson was alleged to have placed five orders between 1 September 2013 and 1 April 2015:
The medications for charges (i) to (iii) above, were intended for her own personal use, as she had previously at various times been prescribed Codeine, Naproxen and Amitriptyline after being involved in a serious car accident in November 2012, as a result of which she suffered from chronic back pain and other problems.
Charges (iv) and (v) above, were intended for her dog, ‘Minnie’, but the dosages ordered were incorrect. The medications were never removed from the practice or given to Minnie, but were instead returned to the wholesaler.
From the outset Ms Hodgkinson admitted the charges against her, although she believed that other staff at the practice had placed similar personal orders and that she had been given permission to do so as well. Ms Hodgkinson also accepted that the facts amounted to disgraceful conduct in a professional respect.
The Committee accepted Ms Hodgkinson’s admission of the charges and, accordingly, found the charges proved. The question of whether the facts amounted to serious professional misconduct was, however, a matter for the Committee’s judgement, notwithstanding Ms Hodgkinson’s admission.
In reaching its decision, the Committee took into account Ms Hodgkinson’s assertion that she believed she had been given permission to order medication through the practice. She did admit however that she must have been mistaken in that belief. The Committee also took note of the College’s submission that a number of aggravating features were present which amounted to serious professional misconduct, namely: the potential risk posed to animal welfare; Ms Hodgkinson’s ignorance of fundamental legislative provisions; a breach of trust placed in her by virtue of her RVN status; the fact that the misconduct was repeated over a period of time; and a lack of awareness of professional responsibilities at the time of the conduct. The Committee therefore had no hesitation that the conduct did amount to serious professional misconduct.
The Committee then turned to the question of sanction. A number of mitigating factors were put forward in Ms Hodgkinson’s defence including the fact that a period of lengthy suspension or removal from the register would result in her losing an offer of employment, the fact that up to the relevant conduct she had had an unblemished career and the fact that she had made early admissions of guilt and shown insight into her misconduct.
The Committee decided that a period of 10 months’ suspension would be appropriate and proportionate in this case.
Chitra Karve, who chaired the Committee and spoke on its behalf, said: "The length of the period of suspension…is intended to reflect this Committee’s view, assisted as it has been by the experience and knowledge of a practising RVN and a veterinary surgeon, of the seriousness of the respondent’s conduct in its totality and of the need for the message to go out to all veterinary professionals that the ordering of POMs without the authority of a valid prescription is a most serious instance of misconduct. In such circumstances the personal mitigations that a practitioner might place before a Disciplinary Committee, whilst not immaterial, is inevitably of limited persuasion. And that is what this Committee has concluded in this particular case, having reflected carefully on the mitigation factors placed before it.
"Having weighed the matters of personal mitigation against the fact that a rudimentary knowledge of the governing legislation was effectively all that was required of the Respondent to ensure that the misconduct complained of did not occur, it is the clear view of the Committee that it would be failing in its public duty were it to do anything less than to impose a period of suspension from practice and the least period of suspension that is appropriate in this case is one of ten months. The Committee therefore instructs the Registrar to act accordingly."
The newly refurbished and extended HQ at Woodrow House in Gloucestershire includes a practical wetlab equipped to share learning with a remote audience, hi-tech lecture rooms and a second teaching room where equipment such as microscopes or X-ray screens can be used.
Meeting rooms include video conferencing technology and giant presentation screens, and there are modern working environments, energy-saving innovations and pleasant break-out areas, all designed to make the building more inspiring, welcoming and comfortable.
Outside there are electric car charge points, bicycle racks and a landscaped area for wildlife with five bird boxes, a small pond and a log pile.
The two-year transformation was unveiled today with an opening address by Lord Trees (pictured right, on the right with Phil Lhermette), who said: "The BSAVA has always been a very dynamic and innovative organisation and this development is the latest example.
"Following their mission to pursue excellence in small animal practice through education and science, the wonderful facilities of this new building will provide a great resource for veterinary education and CPD which of course not only benefits vets and vet nurses but more importantly will ultimately benefit the health and welfare of our pet population.
"The building offers the very latest facilities to deliver high quality teaching and learning and has the capacity to be expanded as necessity dictates. I’m delighted to see the BSAVA investing in the future of the profession and this building, and the online technology it houses including the new digital library, will enable the organisation to continue to deliver its mission well into the future."
BSAVA President Phil Lhermette said: "Over the past 60 years BSAVA has put science and education at the heart of our organisation, and our successful growth includes delivering high quality CPD in an exciting new environment, which will be perfect for everyone to learn in the most conducive way.
"It has been 20 years since we moved into Woodrow House, so it was time for a one-off, ethical transition to create a modern, fit-for-purpose facility for all our members to enjoy."

The winners will be announced at BVA Live at Birmingham’s NEC in May, where this year there is also an opportunity for BVA Live delegates to vote for their favourite image from the shortlist, with a new ‘People’s Choice’ winner being announced in the weeks following the event.
The award has been granted to only a handful of practices and requires the achievement of high standards of care and a detailed understanding of the species.
Highcroft has three dedicated exotic species veterinary surgeons, including a European small mammal Specialist and four exotic species nurses, who have either obtained or are studying for their City and Guilds Exotic Species Veterinary Nursing Certificate.
The practice has a dedicated exotic species consulting room, waiting room, ward and an operating theatre, containing state-of-the-art equipment.
In addition to treating rabbits, both vets and nurses in the exotic species team lecture widely to promote the importance of providing a high standard of care to rabbits and to ensure that their welfare is optimised.
Dr Elisabetta Mancinelli DVM CertZooMed Dipl ECZM (Small Mammal) MRCVS heads the exotic species team at Highcroft. A European Veterinary Specialist in Zoological Medicine (Small Mammal Medicine and Surgery) and a RCVS Recognised Specialist in Zoo and Wildlife Medicine, she said: "We are very proud to have been awarded Gold Status by the RWAF. We will continue to enhance the level of care we provide, not just to rabbits but to all exotic species and strive to improve the welfare of all animals under our care, in hospital and at home."
Pets'n'Vets, a Glasgow-based partnership, has revealed plans to open what it describes as the city's first veterinary 'super practice'.
Located at a 7500 sq ft customised facility in the Auldhouse Retail Park in Pollokshaws, The Roundhouse Veterinary Hospital will provide comprehensive pet care seven days a week, caring for animals around the clock and providing late night consultations when required. Pets'n'Vets says it believes it will deliver a step change to the standard of veterinary care available in the city.
Pets'n'Vets partner Oliver Jackson said: "Having provided excellent veterinary care to the Southside's pets for over 40 years we feel that this will create a cutting-edge facility in which to do so for the next 40 years.
"Our plans for this ambitious new facility have been modelled on the American concept of a vet 'super-practice', designed to deliver the whole suite of pet care services, from nail clipping to vaccinations to some of the most complex surgical veterinary procedures - and will provide these services locally, at sensible cost and to the highest clinical standards with one of the best qualified, first opinion veterinary surgeons in the West of Scotland and one of the best medical experts too.
"This is a really exciting initiative that will bring a real first to Glasgow. It will enable us to care for animals 24 hours a day as there will be nursing staff living on-site so that animals can receive continuous treatment through the night. The Roundhouse Veterinary Hospital will feature a cat examination room which, unusually, will not feature a consult table. Instead, this new facility will feature steps and an artificial tree that will enable the nurse or vet to better assess its movements.
Partner Oliver Jackson said: "This is an ultra-modern arrangement which is aimed at allowing us to examine cats in a more natural way - we hope that this will assist us to diagnose many more cases of feline arthritis, a disease that a recent study accepted was often missed by the traditional, consulting table means of examining cats."
Similarly, the dog room will not feature a consult table but will have facilities for physiotherapy or play - and there will be a special garden enclosure for exercising any dogs requiring to stay at the facility for any length of time.
The 'super practice' will feature separate cat and dog waiting and consultation rooms as well as separate in-patient wards to reduce stress. In the clinical wing, the facility boasts two sterile theatres, specified to the highest clinical standards, with a separate scrub area, a designated dental theatre, large patient preparation area as well as state-of the art diagnostic suites.
Pets'n'Vets says the hospital design has been carefully considered to encourage the best possible clinical care. For example vets' stations overlook the intensive care unit and the preparation area remains open plan, taking advantage of natural light provided by a large overhead atrium, whilst specialist air extraction systems ensures sterility by separating the area into clinical zones.
In addition to the dog and cat accommodation the hospital will also have an isolation ward which will be separate for any animals with potentially contagious diseases and a ward dedicated to less usual pets with facilities for everything from rabbits and guinea pigs to albino hedgehogs as well as vivaria for looking after reptiles.
The Roundhouse Veterinary Hospital will also feature a private area for pet owners needing to spend a little more time, perhaps on those sad occasions when a pet has to be put to sleep, as well as a dedicated and more relaxed room where owners will be able to discuss the health of their pet with the vet.
Oliver said: "We want The Roundhouse to be a place for learning and meeting, so there will be a coffee station for owners and a homely, relaxed and welcoming feeling. We're also planning to host school trips and the facility will feature a little veterinary practice where kids can play, with stethoscopes and little white coats for them to wear.
"As a practice, Pets'n'Vets has always been very involved in training and this new facility will enable us to do that on an unprecedented scale. Our ambition is that The Roundhouse will become a drop-in centre for people to come with their animals to learn and to play as well as to receive medical treatment."
The Roundhouse Veterinary Hospital will create six additional full-time jobs when it opens this summer. Pets'n'Vets says that many of the treatments currently delivered by its nearby surgery on Pollokshaws Road will transfer to the new facility, enabling it to create Glasgow's first dedicated vaccine clinic at the old surgery.
The extension includes a new diagnostic imaging suite with both CT and MRI scanners, a fourth operating theatre, two more consulting rooms, an additional ward for dogs and an expanded office for clinicians.
North Downs hospital director Terry Emmerson said: "This significant investment illustrates our commitment to providing the highest standards of medical and surgical care for our pets in a caring, compassionate environment.

Entries for the awards, which were presented at a ceremony held at Wembley Stadium, came from a wide range of SMEs employing less than 250 employees, operating across all industries.

Last year, over 1,400 veterinary practices collected more than 6,000 ticks from dogs for the Big Tick Project, contributing to the largest-ever study of tick-borne illnesses in dogs in Britain, if not worldwide.
Now MSD is calling on practices to do the same for cats. The company says that data collected from the contributions will be used in a scientific paper which will help vets make more specific recommendations to cat owners, and help keep their pets safe.
Amanda Melvin, Senior Product Manager for Bravecto said: "We were delighted and rather overwhelmed by the response, support and level of interest in the BTP for dogs from the veterinary profession. We were expecting 100s of ticks to be submitted but they arrived in their 1000s!

"We have therefore created the BTP for cats and are asking the vets, once again, to show their support by collecting and sending in ticks from their practices. The more samples we receive the better. This way we can help the profession better understand the risks associated with ticks and how best to help cat owners treat their pets."

To support vets in promoting the BTP for cats to their clients MSD Animal Health has designed a range of materials for display in practice and as takeaways for clients. They include a practice waiting room poster and a cat certificate.
The new leaflet, ‘Separation anxiety as a result of the pandemic. What can you do?’, was written in collaboration with clinical animal behaviourist, Rosie Bescoby, and is aimed at dog owners whose pets are struggling to adjust to the ‘new normal’.
It includes an overview of separation anxiety, including the signs to look out for and how to tackle it, together with training tips to help adult dogs and preventative advice for puppies.
The leaflet also includes advice on the dog fear ladder, which demonstrates the different levels of fear a dog may exhibit resulting in more extreme reactions being displayed, and information on the Adaptil range of products which help support dogs throughout their lives.
The leaflet is available as both a printed and online version to enable vet practices to distribute it to their clients in a format of their choice. It is supported by a social media toolkit for vet practices consisting of posts, graphics and a video.

The tips, put together by Tessa Plagis (communication advisor at St. Anna Advies), Alan Robinson (director of VetDynamics) and Rebecca Robinson (coach at VetDynamics and senior clinician in veterinary anaesthesia at the AHT), are being shared to set the scene for Congress 2023, where international experts will be exploring how time management at organisational, systems, teams and an individual levels can lead to drastic improvements in performance, job satisfaction and wellbeing.
The Association points to the demands on the profession caused by the fact that veterinary professionals have been saying 'yes' to everything for years: yes to more clients, more patients and more overtime.
This, says BSAVA, is taking its toll: experienced practitioners and recent graduates are leaving the profession, and many more are suffering mental and physical health issues associated with sustained high stress.
Tessa Plagis, communication advisor at St. Anna Advies, said: “We are at a tipping point and can’t keep doing what we’ve always done. If we want sustainable veterinary businesses going forward we need to change the structure of how we work.”
Tessa says the issues are both organisational and individual: “Many veterinary professionals struggle to give boundaries.
"We are people pleasers and tend to say ‘yes’, even if that means compromising other important aspects of lives, such as family.
"This set against a background of too few vets, which means that there’s nobody to help us out when there’s too much to-do.”

The Queen’s Medal - the highest honour that the RCVS can bestow upon an individual veterinary surgeon - was given to Dr Mary Stewart MRCVS, a retired academic who spent most of her career at the University of Glasgow where she was responsible for the development of the modern vet school.
Dr Stewart was nominated by Professor Stuart Reid, the Principal of the Royal Veterinary College and former Dean of the Glasgow Veterinary School. In his nomination he said: “Mary Stewart is one of the unsung heroes of the veterinary profession. A veterinarian graduating from Cornell in 1949, Mary has been MRCVS since 1951 and without doubt has been one of the major influencers of ethical approaches in the vet-client-patient environment and, in particular, the impact of euthanasia on both owners and attending veterinarians. Conducting nearly all her professional career in the UK, the vast majority at the University of Glasgow, Mary was of the generation selected by Sir William Weipers to create the modern school at Glasgow, an institution in which Mary played a pivotal role that would have reach nationally and internationally.”
The Inspiration Award is given to vets or nurses to recognise their ability to inspire and enthuse others consistently throughout his or her career. This year, it has been awarded to Dr Freda Scott-Park MRCVS. Freda is a former president of both the British Veterinary Association (BVA) and the British Small Animal Veterinary Association (BSAVA) as well as the current coordinator of the Highlands & Islands Veterinary Services Scheme and a campaigner for identifying the links between animal and other forms of abuse through The Links Group.
The Impact Award is given to vets and nurses who have recently made a considerable impact that has affected the profession at large, animal health or welfare, or public health. This year two Impact Awards have been bestowed. The first is to Dr Rosie Allister MRCVS, a leading campaigner and researcher for and about veterinary mental health, as well as a veterinary educator, the manager of the Vetlife Helpline and a member of the RCVS Mind Matters Initiative Taskforce.
The second Impact Award recipient is Hannah Capon MRCVS, the co-founder and director of Canine Arthritis Management (CAM), a self-funded social enterprise that provides advice to both other veterinary professionals and animal owners on the treatment and management of arthritis in dogs.
This year the RCVS is also awarding three Honorary Associateships, bestowed upon those who are not veterinary surgeons or veterinary nurses but who are making a considerable impact in the veterinary sphere, whether in the field of campaigning, charities, research, politics or journalism, for example.
This year’s first Honorary Associate is Professor Maureen Bain, Professor of Comparative Anatomy and Histology at the University of Glasgow’s Institute of Biodiversity, Animal Health & Comparative Medicine, and an Associate of Glasgow Vet School who has dedicated her career to research on improving the quality and safety of eggs for human consumption.
The second Honorary Associate is Mike Flynn, the Chief Superintended of the Scottish Society for the Prevention of Cruelty to Animals (SSPCA), for his collaborative work with the veterinary profession in areas such as the illegal puppy trade and the Links Group.
The third and final Honorary Associate is Professor Roberto La Ragione, the Deputy Head of the Surrey Vet School where he is also Professor of Veterinary Microbiology and Pathology and Head of the Department of Pathology and Infectious Diseases. Professor La Ragione was nominated for his contribution to veterinary education and research.
RCVS President Niall Connell (pictured right) said: “My hearty congratulations to all of this year’s award winners. Once again, it was a very strong field of people who have made and are making an indelible impact on veterinary science, the professions, animal health and welfare, food safety, public health, and plenty more besides."
Normally RCVS Awards & Honours are presented at Royal College Day in July. However, due to the coronavirus pandemic, the 2020 awards ceremony will instead be part of the proceedings of a combined Royal College Day and Fellowship Day, which will take at the Royal Institution on 2 October 2020. This event may be subject to cancellation and postponement depending on the latest Government advice and restrictions on the prevention of transmission of coronavirus.
The British Veterinary Association (BVA) has launched its new ‘Good Practice Guide to Handling Veterinary Waste’ consisting of a poster and web advice.
Produced in association with the BSAVA and Goat Veterinary Society, and supported by The Environment Agency, the poster, alongside further detailed information on the BVA website, provides practical step-by-step guidance designed to assist veterinary surgeons comply with waste regulations in England and Wales.
BVA President Nick Blayney commended the guide to practices, pointing out that “All businesses have a duty of care to ensure that all waste is stored and disposed of responsibly, that it is only handled or dealt with by those authorised to do so and that appropriate records are kept of all waste that is transferred or received. Under the Hazardous Waste Regulations, all veterinary facilities that produce more than 200 kg of hazardous waste per annum need to register and we realised that this was an area where guidance was needed.”
While the production of the guidance had proved to be “a decidedly complicated and time-consuming exercise, we are” said Mr Blayney “absolutely delighted with the outcome and believe that it will make life considerably easier for the profession.”
With definitions of hazardous, including clinical, waste and non-hazardous waste illustrated simply and clearly, coupled with information on registering of premises, maintaining a waste register and the use of consignment notes the BVA is confident that the guide will prove indispensable.
The Puppy Contract was launched in 2012 to help prospective buyers navigate the steps leading up to the purchase of a new puppy. It includes a ten-step guide which considers things like which type of dog is most suited to a buyer’s situation and specific needs, and the questions to ask a breeder about socialisation, vaccination, microchipping and health tests.
The latest BVA Voice of the Veterinary Profession survey shows that while awareness of The Puppy Contract among companion animal vets has almost doubled since 2015 (from 29% to 56%), it is thought that no more than 2.5% of clients are actually using it.
Nevertheless, 85% of vets said using The Puppy Contract benefits and informs owners, and 20% recommend it to clients at least sometimes.
Half of the vets who were aware of The Puppy Contract said that pet owners did not come to them for advice on buying a puppy. That's a missed opportunity, both to start building a relationship with the prospective client at the earliest opportunity and to recommend the contract and thereby have a positive impact on animal welfare.
As regards the latter, it is worth noting some other BVA stats, notably that 10% of vets said they commonly saw dogs last year with health issues linked to where they were bought from, nearly a third noted brachycephalic issues or other congenital and conformation problems stemming from poor purchasing decisions and 22% saw dogs not suited to their environment.
BVA Junior Vice President and AWF Trustee Daniella Dos Santos said: "As vets, we see first-hand the tragic consequences resulting from puppies bought without proper research into breed suitability and welfare needs, the conditions they have been bred in, or vaccination and microchipping records. As a result, many of these puppies often present with disease, welfare issues and behavioural problems, leading to heartache and financial costs for the new owners.
"It’s extremely encouraging to see that more than half of companion animal vets are now aware of The Puppy Contract and recognise its immense benefits. But with many pet owners still not aware that their vet can be an invaluable first stop for advice on the right pet for them, it’s important that we promote pre-purchase consultations to ensure prospective owners make an informed choice and get a healthy, happy and well-socialised pet from a responsible breeder."

The Disciplinary Committee had found Dr Schulze Allen guilty of four charges, namely that he had been convicted of the criminal offence of petty theft in the US which rendered him unfit to practise, and that on three subsequent occasions, twice to the RCVS and once to a notary in California, dishonestly represented that he had no criminal convictions.
Following the DC hearing, Dr Schulze Allen submitted an appeal to the Privy Council. The basis of his appeal revolved around whether, under Californian law, his conviction for petty theft was a conviction for a criminal offence or an infraction, and whether an infraction under US law was a criminal offence.
The RCVS had argued that while the theft is not a criminal felony in California, it would be considered so under English law.
However, the Board of the Privy Council which heard the appeal – comprising Lords Wilson, Carnwath and Lloyd-Jones, found the College had not proven beyond all reasonable doubt that Dr Schulze Allen was convicted of a criminal offence under Californian law. It therefore upheld his appeal against the DC’s finding that he had committed a criminal offence.
The Privy Council then considered Dr Schulze Allen’s appeal against the third and fourth of the charges against him - that he was dishonest in his representations to the College that he did not have a ‘criminal’ conviction and did not have a ‘criminal record’. The Privy Council found that, since the conviction for petty theft was an infraction, and was not a criminal offence and did not leave Dr Schulze Allen with a criminal record, then, strictly speaking, his representations to the RCVS were not false and so upheld his appeal against these two charges.
The Privy Council then considered Dr Schulze Allen’s appeal against the College’s second charge against him. This charge was that he had, in a written application for restoration to the Register, represented that he did not have any cautions, criminal convictions or "adverse findings". The College argued that he still had a responsibility to make a full and frank disclosure about his infraction, even if it did not meet the threshold of ‘criminal’ under Californian law.
The Board of the Privy Council said it had, on Dr Schulze Allen’s behalf, done its best to identify some argument that his conviction for a petty theft infraction did not amount to an "adverse finding", but failed. Rather, it found that "the conviction obviously amounted to an adverse finding."
The Board added that "there is no material by reference to which the Board [of the Privy Council] can depart from the [Disciplinary] Committee’s conclusion that, in answering “no” to that question, he knew that his answer was untrue. In other words, his denial was dishonest."
The Board therefore allowed the appeal against the DC’s conclusion on the first, third and fourth charges. But it dismissed the appeal against its conclusion on the second charge, namely that in that regard Dr Schulze Allen had been guilty of disgraceful conduct in a professional respect."
The Board then set aside the original sanction, that Dr Schulze Allen be removed from the Register, and tasked the Committee with identifying the appropriate sanction in relation to the second charge.
The Disciplinary Committee will now hold a further hearing to decide the sanction, at some time in the future. In the meantime Dr Schulze Allen remains on the Register of Veterinary Surgeons.
The Veterinary Workforce Summit was held last November, when 80 stakeholders from independent and corporate practices, veterinary schools, charities, government, the food hygiene sector, species associations and industry bodies came together to look at how the profession could address the workforce crisis.
Prior to the Summit, preliminary research was carried out to assess the profession's views on the workforce crisis and how it was affecting them.
Based on findings from the preliminary research, six themes around the issue of workforce shortages were identified and used to structure the discussions of the day.
These were: readiness for work; work-life balance; workplace culture; client interactions; career development; and return to work.
The day was opened by Lizzie Lockett, RCVS Chief Executive, who focused on the issues underpinning the workforce crisis:
Later in the day, delegates were divided into groups and asked to develop ideas and pitch a solution to a problem the sector is facing.

Kate Richards, RCVS President, said: “Although the issues affecting the UK veterinary sector aren’t new, they have been exacerbated over the past few years by factors outside of the sector’s control.
"We know that putting in place solutions to address and solve the issues that the veterinary sector is facing will take time.
"We want to reiterate that the Summit was the first, albeit an incredibly important, first step in co-creating innovative solutions to workforce shortages.
"I look forward to working collaboratively with our veterinary colleagues from across the professions to bring the workforce action plan to life and work on the solutions that come out of it.”
The RCVS says the next steps from the Summit are to consider the feasibility of the suggested solutions and integrate those that seem likely to deliver effective results into an action plan, alongside other activities that are already underway.

The RCVS Disciplinary Committee has dismissed charges of serious professional misconduct against a veterinary surgeon and former employee of Medivet (Watford).
Tomasz Nazimek, who qualified in Poland in 2001 before starting work in England in 2005, was alleged to have charged for the use of a blood pressure monitor during an exploratory laparotomy on a cat called Mitzi, whilst working at the Watford branch of Medivet in June 2009, when he knew, or ought to have known, it had not been used.
Despite his previous signed statements to the contrary, Mr Nazimek admitted at the outset of the hearing that no blood pressure monitor had in fact been used.
Accordingly, the Committee only had to establish whether Mr Nazimek himself had entered the fee for its use into Mitzi's records and, if so, whether this was done dishonestly.
The alleged incident came to light as a result of a covert investigation into Medivet conducted by the television production company Fulcrum TV in 2008/9, and subsequently commissioned by the BBC and broadcast in July 2010 as part of the Panorama programme 'It Shouldn't Happen at a Vets''.
Former dental nurse Alexandra Lee was employed by Fulcrum TV as an undercover reporter to work as a 'trainee veterinary nurse' at Medivet, in order to record audio and video footage of her experiences there.
The case against Mr Nazimek was based partly on a conversation overheard by Miss Lee following the operation on Mitzi, where she maintained that Guy Carter, a senior Medivet partner and veterinary surgeon, told Mr Nazimek (who was sitting at the practice computer typing up Mitzi's records) not to forget to include a fee for use of the blood pressure monitor.
However, Miss Lee's equipment had not recorded this exchange, due to a fault, and her video diary of that day's events was not put in evidence before the Committee. Miss Lee also accepted in evidence that she had not actually seen who entered the fee into the records, but had assumed it was Mr Nazimek.
Despite giving serious consideration to all of Miss Lee's evidence, the Committee found it of limited value.
The Committee considered the statements signed by Mr Nazimek, but prepared for him by the Medivet senior management in December 2009 and October 2010, which stated that he had used the monitor, consulted Mr Carter about charging for it and then added the fee himself.
The Committee also considered a third statement provided to the College (September 2011), in which Mr Nazimek recalled that Mr Carter had priced up the operation himself, but not asked for his input.
When questioned about the discrepancies in his statements, Mr Nazimek told the Committee that he had confused different operations and now knew his earlier statements to be wrong.
He indicated that he had been under pressure from his then employers to sign the statements, that his attempts to change them were ignored by Medivet's managing partners and that he was depressed and under stress at the time.
He was not told that the statements could be in relation to charges against him, or that he was entitled to legal advice when discussing them with his employers.
The Committee found Mr Nazimek's oral evidence to be persuasive, his manner open and his responses under cross-examination frank.
In the absence of satisfactory and reliable evidence to the contrary, and in view of supportive testimonials provided from his current employer and former colleagues as to his honesty and integrity, the Committee found Mr Nazimek's repeated assertion that he did not make a charge for the monitor "entirely plausible" and believed that he told the truth.
Nevertheless, the Committee emphasised that a charge for the monitor had been entered into the records when no such device had been used, which it regarded as unacceptable.
Speaking on behalf of the Committee, Chairman Professor Peter Lees said: "The Committee is not satisfied by the evidence so that it is sure that [Mr Nazimek] entered into the records for Mitzi a charge for the blood pressure monitor. [It] believes that [Mr Nazimek] told the truth when giving his evidence and the character references support his honesty.
"In these circumstances, it is not necessary to consider the charges further and the allegations against [Mr Nazimek] are dismissed."
This is despite the fact that 84% of the 524 veterinary professionals that were polled said they believe that veterinary wellness is very important to the success of their practice.
Perhaps as a consequence, the survey found many respondents taking steps to look after their own wellness, with 57% saying they have started an exercise regime, 54% saying they have taken up other hobbies outside work and 44% saying they are talking more openly to colleagues to share problems and offer support.
When questioned about the obstacles to improving wellness in their practice, 'staff not having the time to focus on it' was cited by 76% as the main barrier. 52% said it was not recognised as an issue, while a further 49% said that the lack of trained personnel to champion wellness was the biggest problem.
Of those practices which had initiated a wellness programme, 83% said it made a positive difference. The most commonly reported wellness initiatives were the provision of a counselling service (38%), online resources (32%), and appointing a practice wellness champion (30%).
When asked what one thing their practice could do to enhance veterinary wellness, the two most popular suggestions were:
Improved communication and support with more openness and empathy (26%)
Improved team working with more breaks and a quiet area for staff (24%)
10% said that an acknowledgement that wellness was actually an issue would be a start.
VET Festival organiser Nicole Cooper said: "What we find startling about these results is that, despite a growing appreciation of the importance of veterinary wellness, almost half of the UK’s practices still don’t recognise it as an issue.
"The good news from this survey is that many veterinary professionals are now starting to take responsibility for their own mental health, whether through taking up interests outside work or sharing problems and experiences more openly at work. We urge more practice leaders to step up and to prioritise enhancing the wellness and wellbeing of their dedicated teams.

The new tool uses aggregated data from Banfield Pet Hospital medical records to identify whether a dog has a high, medium, or low risk of having PD based on the breed size1,2,3,4,5, age, and body condition the owner has stated3,4.
It also makes oral care recommendations based on the dog's history (e.g., diet, previous extractions, halitosis), clinical signs (e.g., bleeding gums) and current dental routine (e.g., tooth brushing).
Global Petcare R&D VP at Mars Pet Nutrition, Dr. Elise Malandain said: “This new risk assessment tool will help indicate to pet owners what level of risk their pet is at for developing this disease to help inform conversations with veterinary professionals about prevention or treatment.”

Miss Johnson was convicted at North Somerset Magistrates’ Court following a guilty plea of the offence of theft by employee in December 2023, after she stole buprenorphine belonging to Yatton Vets earlier that year.
She was sentenced to a fine of £120, a surcharge of £48, and costs of £85.
There were four further charges against Miss Johnson.
Charge one related to Miss Johnson stealing 5ml of methadone in December 2022 from her employer, Vets4Pets in Bristol, and injecting herself with the methadone.
The police investigated the incident and Miss Johnson accepted a conditional caution for the theft, the condition being she should attend a drug awareness course.
Charge two related to Miss Johnson dishonestly taking a syringe of methadone in August 2023 from her employer, the Langford Small Animal Hospital, and injecting herself with it.
Charge three related to two dates in September 2023 when she dishonestly took methadone, gabapentin and buprenorphine from Yatton Vets, her then employer, injecting herself with the buprenorphine and then working when unfit to do so.
Miss Johnson was later convicted of theft in relation to the buprenorphine (charge five).
Charge four related to an incident in November 2023, when Miss Johnson dishonestly took a syringe of buprenorphine from Bristol PDSA, for the purposes of self-administration, and was dishonest both to other members of staff and in the clinical records about the circumstances of taking the buprenorphine.
Charge five was in relation to Miss Johnson’s criminal conviction.
At the outset of the hearing, Miss Johnson admitted all charges in their entirety.
Having reviewed all the evidence and taken Miss Johnson’s admissions into account, the Committee found each of the charges proved.
After the criminal proceedings had finished and had been reported to the College, Miss Johnson wrote a letter expressing her deepest apologies to both the RCVS and the profession.
Within this she also made it clear that she took full responsibility for her actions.
In a later statement, she added that she had tried to use the experience to learn and improve in every aspect of her career and life and did not want to defend her behaviour.
Within this statement she also retracted a previous request to resign from the register, stating that she would accept any outcome to the investigation.
In deciding whether the proved charges amounted to serious professional misconduct, the Committee took the following aggravating factors into account:
The Committee identified no mitigating factors and concluded that for each of the individual charges Miss Johnson’s conduct fell far short of the conduct expected of a member of the profession and that each of the charges one to four amounted to serious professional misconduct.
In relation to charge five, the criminal conviction, the Committee noted that the nature and the circumstances of the offence involved dishonesty, abuse of her professional position regarding access to controlled drugs, breach of her employer’s trust, and that the misconduct took place notwithstanding an investigation by the police for similar conduct in December 2022.
The Committee therefore concluded that charge five rendered Miss Johnson unfit to practise.
When deciding on a sanction, the Committee took into account mitigating factors, which included:
The Committee found no further aggravating factors at this stage.
Kathryn Peaty, chairing the Committee and speaking on its behalf said: “The Committee considered that the overall misconduct proved so serious and was incompatible with remaining on the register.”
She added: “The Committee accepted that Miss Johnson was currently likely to be drug-free on the basis of her evidence and that of her referee, but it noted that independent testing proving she had been drug free for any period of time was not available to it.
"Furthermore, Miss Johnson had been unable to demonstrate that she had worked without any incident recently as she had accepted she had been dismissed from her recent job.
“Having taken into account all of the aggravating and mitigating factors, and balancing the public interest and the need to uphold and maintain standards within the profession, and having decided that Miss Johnson’s insight was limited, the Committee concluded that the sanction of ‘removal’ was the only proportionate sanction it could impose in this case.
"It also decided that such a sanction maintained public confidence in the veterinary profession, safeguarded animal welfare and protected the public from any future risk of repetition of similar behaviour.
“The Committee therefore directed that the Registrar remove Miss Johnson’s name from the register of veterinary nurses forthwith.”

Plimsoll has published the results of a study into the profitability of UK veterinary practices which has revealed a widening gap between firms making outstanding profits and those losing money.
The Plimsoll Analysis found average profit margins have fallen to 6.4% of sales and 151 of the UK's top 500 practices are now running at a loss. However, the same study has revealed 61 businesses are making record profits.

Mr. Pattison added: "The latest Plimsoll Analysis highlights that the industry is being split into two types of company and the gap between the rich and the poor is getting bigger and bigger.
"For the companies that are falling behind, they need to re-evaluate their strategy and retain profit in order to improve their financial strength."
