The RCVS Disciplinary Committee has struck off a Wiltshire-based veterinary surgeon for charges relating to tuberculin (TB) testing on cattle that he undertook and certified at four farms during June and July of 2010.

At the end of the ten-day hearing, the Disciplinary Committee found Sorin Dinu Chelemen guilty of 32 charges relating to his work as an Official Veterinarian (OV) for Animal Health, while employed as a locum at Endell Veterinary Group, Salisbury. Mr Chelemen, who represented himself at the hearing, disputed all of the charges. He also said he had had poor knowledge and comprehension of written and spoken English at the time, which had since improved.

Mr Chelemen gave the Committee detailed accounts of what he said occurred in relation to the TB testing at all four farms. However, in almost all the points where the facts were denied, the Committee found a stark divergence between his evidence and that given by witnesses for the College.

The Committee was generally unimpressed by Mr Chelemen's account of events, finding many of his allegations and explanations for his actions to be incredible or unreliable. For example, he claimed that during his Animal Health training, he had not been given a copy of the 'Manual of Procedures' containing Standard Operating Procedures (SOPs) for TB testing. Although the Committee accepted Mr Chelemen's English had been poor at the time, leading to communication problems, he had satisfactorily demonstrated that he knew how to perform TB tests in accordance with these SOPs when he started work at the practice. Overall, the Committee found Mr Chelemen's attitude was that he had not done anything wrong and nothing was his fault, and that he had little understanding of the professional responsibilities incumbent on an OV.

By contrast, the Committee considered all the witnesses called by the College to have given clear, credible and consistent evidence. Complaints had been made about three farms that were separate and unconnected, and where the tests had been conducted on different dates. These complaints, if not identical, were very similar. The evidence was overwhelming that Mr Chelemen had not followed the SOPs when carrying out testing at three of the farms.

The Committee noted that the measurements recorded by Mr Chelemen did not show the differences which would be normally expected. Mr Chelemen had not measured the animals in accordance with the SOPs when he knew he ought to have, and he had been dishonest in certifying the tests.

When considering sanctions, the Committee found an aggravating factor was that Mr Chelemen's actions undermined procedures to prevent the spread of disease. In particular, he failed to notify the owners of animals on three farms that he had found reactors or inconclusive reactors, resulting in those animals not being isolated. Nor did he submit paperwork to Animal Health about these animals, which was a fundamental breach of his duties as an OV.

In mitigation, the Committee accepted that Mr Chelemen had no previous RCVS disciplinary findings against him; and, that the OV training he received was limited, having regard to English not being his first language and relative inexperience as a TB tester. It also took into account that this disciplinary case had been in progress for three years, his poor health and his financial and family circumstances.

Mrs Judith Webb, chairing and speaking on behalf of the Committee said: "The Committee is of the view that this is a most serious case, in which the integrity of TB testing was undermined, and animal health was put at risk, which may have resulted in the spread of disease. Furthermore, this case involves findings of dishonesty, which has been held to come at the top end of the spectrum of gravity of disgraceful conduct in a professional respect."

She directed that Mr Chelemen be struck off the Register.

The RCVS has published its Annual Report and Financial Statements for 2018, in which it highlights what it considers to be its major achievements over the year.

They include the successful completion of its governance review, the launch of the Graduate Outcomes consultation (the biggest in 20 years) and the Edward Jenner Leadership Programme (a massive open online course to develop leadership skills at all levels of the profession).

The College also highlights the continuation of its Mind Matters Initiative and how the initiative's aim - to encourage a compassionate and empathetic profession - is becoming a central part of the College's core strategy.

The report also covers the work done by the College to explore an outcomes-based approach to continuing professional development (CPD), review Schedule 3 and the Veterinary Surgeons Act, plan for the UK’s exit from the European Union and promote (jointly with the BVA) the benefit of registering with a vet to the public via a social media campaign.

The report includes the College’s independently-audited finances with details of income and expenditure. Whilst the College is not a charity, the accounts have been prepared in accordance with the Charities Statement of Recommended Practice – a framework for charity accounting and reporting, which allows easier comparison with the finances of similar bodies.

The report will be presented for adoption by members of the College at this year’s RCVS Day on Friday 12 July 2019 at the Royal Institute of British Architects.

Yorkshire-based Animal Trust, the somewhat controversially named not-for-profit veterinary practice, has announced it is opening a second practice in Dewsbury, less than a year since it opened the first one up the road in Tingley.

Set up by veterinary surgeons, Animal Trust trumpets the fact that its main focus is on the welfare of animals. How that makes it different to any other practice in the country is hard to see, however Animal Trust also says that it reinvests all profits back into the business for the benefit of its patients. 

Owen Monie, the founder of Animal Trust, said: "We couldn’t be prouder to be opening our second clinic in Yorkshire.

"The success of our Tingley clinic has increased demand across the county, therefore we identified the need of a not-for-profit veterinary clinic further west in Yorkshire."

"Unlike most veterinary clinics, we offer free consultations with experts to enable patients to access care and advice on treatment exactly when they need help."

No doubt the practice's charitable-sounding name and positioning will continue to grate others in the profession who also do so much pro-bono work.

Still, you've got to credit Dr Monie: it's a powerful consumer proposition he's got there.

Virbac has announced that Ovarid is back in stock following the resolution of a manufacturing problem. 

The megestrol acetate tablets are indicated for the postponement or prevention of oestrus and the treatment of hypersexuality in male dogs. In cats they are recommended for the prevention or postponement of oestrus and the treatment of miliary dermatitis and eosinophilic granulomata.

Virbac says that because the product is relied on by the owners of many cats suffering from miliary eczema, it has worked to ensure that their welfare is not compromised by recalling unused Ovarid stock from practices to ensure that it could still be provided to those contacting them with emergency cases since the outage began in February.

Senior Product Manager Chris Geddes MRCVS said:  "I'd like to express my thanks to practices for bearing with us and particularly to those which returned unused product. This meant that we were able to supply emergency supplies for the treatment of miliary eczema to every practice that asked for it. We also managed to help out some zoos which needed supplies for frisky sea lions and lions."

Ovarid is available in 20mg and 5mg tablets.

According to a report in last weekend's Mail on Sunday, documents leaked from Defra have revealed proposals for a range of measures designed to reduce the risk from dangerous dogs.

The proposals reportedly include:

• All owners required to take a 'competency test' to prove they can handle their dog. The cost of the test has been estimated at £60.
• All owners required to buy third party insurance.
• All owners required to microchip their pet

The first of these looks like being a bit of a non-runner. Aside from the subjective nature of deciding what makes a competent owner, the cost is disproportionate to the size of the problem: 703 convictions for dangerously out of control dogs in 2007. The other two seem long overdue.

The RCVS Disciplinary Committee has refused an application by Warwick Seymour-Hamilton to be restored to the Register of Veterinary Surgeons.

Mr Seymour-Hamilton was originally removed from the Register in June 1994 for failing to maintain his practice’s equipment and facilities in working order and for a total disregard of basic hygiene and care for animals, thereby bringing the profession into disrepute.

The restoration hearing on 20th May was Mr Seymour-Hamilton’s seventh application for restoration. Previous applications had been heard but refused in July 1995, June 2010, February 2015, March 2016, May 2017 and April 2018. However, as the Committee makes its decision on the merits of the case before it, those previous applications were not considered as relevant to its current decision.

The Committee heard oral evidence from Mr Seymour-Hamilton and were shown clear bottles with liquid, a container with tablets and petri dishes with grown cultures as detailed documentary evidence. In respect of any concerns regarding keeping his veterinary practice up-to-date, Mr Seymour-Hamilton said that “you never lose that skill” and explained that he kept up-to-date through extensive reading and conversations with veterinary surgeons in Europe. 

However, the Committee had significant concerns as to his fitness to practise safely as a veterinary surgeon for a number of reasons, including that nearly 25 years had passed since he was last in practice and that there was little, if any, evidence of him keeping up-to-date with the knowledge and skills required to practise as a veterinary surgeon.

Ian Green, chairing the Committee and speaking on its behalf, said: "The applicant worryingly did not accept that he was in any way deskilled by the passage of time. The evidence that the applicant has provided showed limited interaction with other veterinary surgeons and there is no documented evidence of the discussions or structure of the meetings he had with veterinary surgeons in Europe.

"There is no evidence of a prolonged and intense period of re-training by way of relevant study to demonstrate that a sufficient level of competence to return to practise has been achieved. In the absence of such evidence the Committee was of the view that there would be a serious risk to the welfare of animals if the applicant was restored to the Register.

"Further, it was a grave concern to this Committee that the applicant demonstrated worrying attitudinal issues towards individuals of a different religion and his attitude to employing a minor when he knew it to be against the law. Such attitudes are incompatible with professional standards the public would expect of a veterinary surgeon."

Finally, with no evidence of public support for the applicant, the Committee concluded that the application for restoration should be refused.

A former pet industry nutritionist has created a stir in the national newspapers with the launch of whichdogfood.co.uk, a website which dismisses veterinary diets as no different to the "awful" standard pet foods sold in pet stores and supermarkets.

According to reports in the Daily Mail, Daily Telegraph and Daily Express, David Jackson says the objective of his website is to change the way people buy pet food because "pet food manufacturers have been able to get away with producing frankly awful foods for our pets."

Explaining why veterinary surgeon sell prescription diets, Mr Jackson trots out some well known arguments which will be familiar to anyone who has followed the propaganda put out by the raw meaty bones (RMB) lobby: that veterinary surgeons are not taught enough about nutrition; that those training modules that exist are largely sponsored by manufacturers, and that veterinary practices benefit from 'massive cash incentives' from the manufacturers and distributors of veterinary diets.

Mr Jackson does say that there are exceptions to the rule, notably those veterinary diets developed to help pets with intolerance, allergies or uroliths.

The BVA has announced the launch of 'Back to Practice', a new CPD series designed to help veterinary surgeons increase their skills and confidence prior to returning to practice after a career break.

Sessions in the 'Back to Practice' series will include updates on changes in practice, and refresh knowledge in key areas such as ophthalmology, dermatology and veterinary medicines. 

The BVA says its research has found that around one in five veterinary surgeons who started their careers in clinical practice report that they do not currently work in practice.

There are, of course, various reasons why veterinary surgeons take a break from practice or change their career path, including having a family, working abroad, taking a sabbatical, because of health reasons, or to search for a new challenge.

Whatever the reason for taking a break, returning to practice can be both exciting and daunting.

Natalie Russell MRCVS is a companion animal veterinary surgeon who has taken time off on maternity leave. She said: "For me the main challenge about returning to practice was the self-confidence. Not only in my knowledge but also in my people skills. Many of those skills hadn’t gone and the knowledge was still there but a course like the 'Back to Practice' series would have helped me prepare and feel more confident in what I knew and how to apply it."

Ex-BVA President Robin Hargreaves also returned to practice after his year away on presidential duties. He said: "It was quite a shock when I returned and, on reflection, I think it would have been valuable to have attended a course like the BVA Back to Practice series.

"Firstly, because after a year there were new approaches and medicines with which I wasn’t familiar and, secondly, because a course like this would have helped to reassure me that I hadn’t forgotten everything and also highlight what I needed to brush up on. It would perhaps have been easier to do this in a collegiate environment with fellow vets rather than in the consulting room."

The first Back to Practice CPD session: 'Return to work with confidence and clarity', will be held on 20 February 2018 at the BVA offices in central London. There will be five other sessions in the series and the BVA is offering a three-for-two offer on the courses.

MSD Animal Health has launched the Yard Excellence Scheme to help yards and veterinary surgeons collaborate in developing best practice healthcare policies.

The scheme, which is part of the company's Keeping Britain’s Horses Healthy campaign, includes a pack - endorsed by BEVA and World Horse Welfare - to help yard owners and vets educate owners why they should vaccinate and the benefits of preventative healthcare.  

The Yard Excellence Scheme pack includes information on vaccination, weight management, worming and biosecurity. It also helps yard owners implement a range of preventative protocols covering things like worming, vaccination and managing new arrivals, and also put infectious disease outbreak protocols in place. 

There are also various things to promote the scheme within the yard, such as yard posters, a horse owner checklist, horse records and responsible horse owner booklets.

All the yards that develop and implement appropriate protocols, in collaboration with their vet, will achieve the Keeping Britain’s Horses Healthy Yard Excellence Scheme Standard and will be promoted on the scheme's Facebook page (@keepinghorseshealthy). 

Yards can also promote their achievement via social media and on their website.

The Competition and Markets Authority has completed its review of the veterinary sector, concluding that there are five main areas of concern and proposing a formal Market Investigation, subject to a 4 week consultation. 

The CMA review generated 11,000 responses from people working in the veterinary industry, including 1/5th of the country's vets and nurses. There were a further 45,000 responses from the general public. 

Issues identified by the review were that:

• Consumers are not being given enough information choose the best practice or the right treatments. The CMA highlighted that 80% of practices don't display any pricing information on their website, that consumers are often not informed about the cost of diagnosis or treatment before agreeing to it, and the lack of transparency over the ownership of corporate practices.
• In some areas of the country, corporatisation may be killing off competition. 
• Large groups which have invested in expensive, advanced equipment may be incentivised to offer more sophisticated, higher cost treatments, making consumers less able to access simpler lower cost treatments. They have also bought related businesses, such as referral centres, diagnostic labs, crematoria and out of hours care, providing an incentive to provide these services in-house to the detriment of choice and competition. 
• Pet owners may be paying too much for medicines: around 25% of pet owners are unaware they can have prescriptions fulfilled elsewhere, and there is little incentive for practices to advise owners that they have a choice. Furthermore, under the current regulatory framework, practices are often unable to source medicines at prices that can compete in the marketplace.
• Under the current framework, the RCVS regulates at practitioner level, meaning it has limited leverage over the commercial and consumer-facing aspects of veterinary business, such as how prices are communicated or whether there is transparency over practice ownership.

So far, the RCVS, the BVNA and IVC have all responded to the announcement, the RCVS welcoming the call for modernising the regulatory framework and the BVNA likewise (taking the opportunity to remind everyone that this would also be the moment to protect the 'veterinary nurse' title).

Meanwhile, IVC said that for its part, it has always tried to ensure its prices are competitive and that customers are informed of costs before treatment, adding that it believes price increases in the sector have been driven predominantly by the shortage of vets, necessary improvements to pay and conditions for veterinary professionals and inflation.  

The CMA has now launched a 4-week consultation to seek views from the sector on the proposal to launch a market investigation.

The consultation closes on 11 April 2023 at which point it will consider the responses received and a decision will be made on how to proceed.

MSD Animal Health has announced that Horse Health Week, which runs from 25th to 29th March 2019, will focus on helping owners and yards understand infection risk.

It's a subject that will be front of many people's minds following the recent cases of equine flu.

As part of the campaign, MSD has produced a range of veterinary practice support materials to help you engage with owners and yards on the subject of preventative healthcare best practice and compliance.

The range includes shareable social media content, videos, a 'What's Your Risk' practice poster, an online risk assessment tool and a number of downloadable information leaflets. Practices will also be supported through the Keep Britain's Horses Health (KBHH) web page, Facebook page and Twitter.

MSD says there are also planning and evaluation resources to help practices manage an effective campaign.

Yorkshire-based Paragon Referrals has launched a superficial radiation therapy (SRT) service for pets, the first of its kind in the country. 

The service uses an Xstrahl 100 superficial radiotherapy system, a £150,000 piece of equipment installed by Paragon after it was used successfully in the USA by the hospital's medical and radiation oncology specialist, Dr Rodney Ayl.

Rodney (pictured right) says the new equipment will transform the way Paragon can treat skin cancers, dermatological disorders and some other common superficial conditions.

He said: “This is a very exciting development for us and our clients because Xstrahl systems have been used so successfully in human medicine for many years.

“This prompted us to explore adapting the SRT system for veterinary use in the UK and we hope to collaborate with Colorado State University, which has a similar unit, to develop protocols for pets.

“We believe this will be a significant advance in the treatment and care of animals and we’re delighted to be at the forefront of introducing this new service.

“It is the only one of its kind for pets in the UK and there are very few units like this anywhere in the veterinary industry, so it really is an important move forward.”

Xstrahl radiotherapy systems were originally designed for the treatment of skin cancer, dermatological disorders, certain types of benign disease and some palliative care in humans.

Rodney says that having adapted the SRT system for animals will transform their treatment and the logistics and cost of getting radiation therapy for superficial skin conditions.

He added: “Superficial radiotherapy is particularly useful for treating some types of skin cancer where it may be preferable to surgery as it can deliver excellent non-invasive outcomes with curative or palliative intent.  

“The treatment is less stressful from the outset and, thanks to its mechanism of action, it is also pain-free. 

“Its use of different size cones, directly over the lesion, minimises effects on healthy skin and the fast treatment means a large reduction in time and impact on the patient’s day-to-day life, while providing a highly-effective treatment.

“The machine’s flexibility also makes it particularly suited for treating multiple lesions that are difficult to access, such as the head and neck, without changing patient positioning.
