The RCVS Disciplinary Committee has reprimanded and warned as to his future conduct a Hampshire veterinary surgeon found guilty of serious professional misconduct for cumulative failures to provide adequate professional care, and insufficient regard for animal welfare whilst treating a dog that had ingested broken glass.
The sanction was decided following a 12-month postponement of a decision ordered at a hearing on 19 November 2010.
At last week's hearing, the Committee was asked to decide what sanction would be appropriate in the case of Peter Ardle MacMahon for his treatment of a Cocker Spaniel called Wilfred, while working as a locum in Portsmouth. In 2010, the Committee found that Mr MacMahon had not removed the ingested glass from Wilfred's stomach or adequately checked that he had done so; had inadequately prevented abdominal contamination; and, had failed to communicate this contamination problem to Wilfred's usual veterinary surgeon. Considering these charges cumulatively, the Committee found that the treatment Mr MacMahon provided to Wilfred had fallen far short of the standard to be expected in the profession and amounted to serious professional misconduct.
Shortly prior to treating Wilfred, Mr MacMahon had returned to practice after a ten-year absence and, at last year's hearing, agreed to comply with undertakings regarding his professional development. These included performing at least 70 hours of medical and surgical continuing professional development (CPD); providing the Disciplinary Committee Chairman with quarterly CPD reports and two employer reports regarding his competence; observing 24 days of current practice by shadowing another veterinary surgeon; and, providing reports from this veterinary surgeon as to his competence and a case diary.
The Committee considered the factual findings from the November 2010 hearing and the concerns then expressed about Mr MacMahon's conduct and capabilities as a veterinary surgeon, as well as his compliance with the agreed undertakings. As advised by the Legal Assessor, the Committee's considerations of sanction began at the lowest level that would ensure that the welfare of animals was properly protected; that proper standards would be maintained among practitioners in the profession; and, that would be in the interests of the public.
Speaking on behalf of the Disciplinary Committee, Chairman Professor Peter Lees said: "The Committee is satisfied that the respondent had complied fully with the spirit of the requirements of the undertakings he had entered into on 18 November 2010. Indeed, the view is that the respondent has done well to achieve the level of compliance that he has, given that he had suffered a period of significant ill-health during the period since he entered into those undertakings.
"The ultimate decision is that the respondent's conduct [...] warrants the imposition of at least a reprimand," he continued. "However, it is also the Committee's firm view that the respondent must be warned about his future conduct so that he will know the Committee considers he needs to maintain the level of continuous professional development that he has achieved [over the last] 12 months, and to have constantly in mind the paramount obligation of all veterinary surgeons to ensure the welfare of animals under their care.
"Such a warning as to future conduct should, and the Committee believes that it will, serve as a constant reminder to the respondent that he must undertake only those procedures, and only proffer professional advice, in the areas where he has the requisite up-to-date skills, knowledge and experience."
The Committee reprimanded Mr MacMahon and warned him as to his future conduct.

The researchers say the effectiveness of cheaper devices could result in wider use amongst farmers, vets and hoof trimmers helping to identify lameness earlier.
The study, led by RVC undergraduate veterinary student, Aidan Coe, alongside Dr Nicola Blackie, a senior lecturer in Production Animal Science at the RVC, compared the thermal images of 83 cows’ hind feet, captured with both high and low cost thermal imaging devices.
Very little difference was identified in the performance and quality of the devices despite the low-cost device being 2% the cost of the high cost device.
Images captured suggested that low-cost thermal imaging devices would be the most cost-effective choice to aid in the identification of lameness.
This study highlights the effectiveness of cheaper infrared thermal imaging devices in identifying the condition which has the potential to lead to the wider use of the devices by farmers, vets and hoof trimmers, in turn allowing the condition to be identified earlier.
Whilst high-cost devices have sometimes been used to detect lameness in cattle, the price point of up to £20,000 and fragility has previously limited their usefulness in a farm setting.
Aidan Coe, Undergraduate Veterinary Student at the RVC, and lead researcher on this paper, said: “There is a possibility that low-cost infrared thermal imaging devices could be used as an objective, cost-effective method of assessing the lameness of the national herd, which may prove a useful adjunct to the current lameness detection methods.”

For the study, researchers from the RVC’s VetCompass Programme identified 2,105 hypothyroidism cases diagnosed amongst a study population of 905,553 UK dogs.
This revealed an annual frequency of one case in 400 dogs (0.23%) for the condition, with the most common breeds diagnosed being Standard Doberman Pinschers (x 17.02), Tibetan Terriers (x11.25), Boxers (x10.44) and Alaskan Malamutes (x 9.71).
The average age at first diagnosis was 7.65 years.

Dr Rebecca Geddes, Lecturer in Small Animal Internal Medicine at the RVC Queen Mother Hospital for Animals and last author of the paper, said: “It is great to have this data from UK primary care practices, which will help highlight high risk breeds to veterinary surgeons so they can diagnose and treat affected dogs as early as possible. Hypothyroidism is usually straightforward to manage with medication that can greatly improve quality of life in affected dogs.”
CVS has announced the official opening of Lumbry Park Veterinary Specialists, a new small animal referral hospital in Alton, Hampshire.
The hospital was officially opened last Saturday by the Town Mayor of Alton during an open day attended by local dignitaries, about a hundred vets and representatives from the veterinary industry and various animal charities. Dr Caner Salih, a consultant cardiac surgeon at the Evelina London Children's Hospital was a special guest.
CVS says it has invested more than £4.3 million to create one of the most advanced, multi-disciplinary specialist veterinary hospitals in the UK. It occupies 1,300 square metres and employs forty people, including nine referral clinicians (seven of whom are boarded specialists), support and admin staff.
Lumbry Park offers a range of advanced diagnostics and treatments for dogs and cats across a range of specialties, including high-field MRI and CT scanning, key-hole surgery, interventional cardiac procedures, and joint replacements. Davies Veterinary Specialists (DVS) has announced that it has completed development work on its premises in Higham Gobion, Hertfordshire, to improve capacity and workflow for diagnostic procedures including MRI, CT and endoscopy.
The new development includes the construction and outfitting of an anaesthesia induction room with two state-of-the art stations, a diagnostic imaging viewing room, a further ultrasound and procedures room and office space for the nurse supervisor team. The rooms were built inside the site’s central barn as the next phase of DVS’s ongoing expansion programme, which has recently seen the completion of a new staff room and upgraded kennels and cattery facilities.

Defra has announced that new rules on pet travel will be introduced from 1st January 2012. The changes will mean that the rules on rabies vaccination for entry into the UK will be in line with the rest of Europe.
Defra has carried out a risk assessment to find out how the changes will affect the level of risk of rabies entering the UK. Although the probability of rabies introduction into the UK will increase, the assessment found the risk will remain very low after the increase.
The British Veterinary Association and the British Small Animal Veterinary Association are informing their members of the new rules so that the right advice can be given to pet owners planning to travel abroad with their animals.
Dogs, cats and pet ferrets entering the UK from an EU or 'listed' third country from 1 January 2012 must:
The current requirement to carry out a blood test followed by a six-month wait before entry into the UK will no longer be required.
From 1st January pets entering from a non-listed third country must pass a blood test 30 days after vaccination followed by a three-month wait.
Until now, the UK, Ireland and three other Member States have had derogations from EU pet travel rules to allow for additional controls to protect against rabies, ticks and tapeworms.
Successful vaccination programmes in wildlife in mainland Europe have now allowed the UK to consider whether the additional controls for rabies are still necessary.
The BVA and BSAVA have continued to lobby in Europe for additional controls to be maintained for tapeworms, which could introduce Echinococcus multilocularis to the UK - a significant public health concern.
Although a final decision has not yet been made the European Commission has indicated that it will support the UK case for additional tapeworm controls.
Harvey Locke, President of the BVA, said: "It is vital that any controls on animal movements are proportionate to the risk.
"Due to the highly successful vaccination programme in wildlife in mainland Europe there has been a huge reduction in the incidence in rabies. Research carried out by Defra reveals that the risk of introducing rabies under the new rules is very low.
"However, it is essential that pet owners get good veterinary advice when planning to take their animals abroad because pets can be exposed to a number of diseases not currently endemic in the UK, for example leishmaniasis, babesiosis, and ehrlichiosis.
"As part of responsible ownership we would always advise pet owners to visit their vet for a pre-travel consultation to discuss how to protect the health and welfare of their animals when travelling abroad."
Andrew Ash, President of the BSAVA, added: "The Pet Travel Scheme has been highly successful in keeping the UK free of rabies. BVA and BSAVA have been working closely with Defra to ensure that any changes to the pet travel rules do not threaten our disease-free status.
"The rabies vaccine has advanced and now has a longer duration of immunity and we welcome the continuing requirement for all pets to be vaccinated before travel."

New research released today by Petplan has revealed that at a time when marriage is in decline and the average child bearing age is increasing, a new breed of pet owner has emerged: women between the ages of 25 and 34 who bought their pet as a substitute for a child.
More than 10,000 pet owners were surveyed for the research and the results apparently reveal 'pet parenting' as a growing trend. According to the survey, women not only look to their furry friend for companionship but also treat them like they would a child, with nearly 70% buying them birthday and Christmas presents, 28% adapting their homes for their pet and 20% changing their holiday destinations to allow their pet to come along too.
Just like working parents, owners worry about leaving their pet alone when they're working. So much so that they make a concerted effort to make sure their pet is not left alone for more than five hours a day - employing dog walkers and cat sitters to stem their concern (approaching 1 in 7). When an 8 hour working day is the national norm and the average parent only spends 49 minutes a day with their children, this demonstrates considerable pet commitment.
Dr Deborah Wells, expert in the study of the psychology of the pet-human relationship said: "Dogs and cats can offer their owners many of the benefits frequently provided by children, including companionship, entertainment and happiness. For some owners, notably women, pets can provide a useful training ground in 'motherhood', in some cases helping to shape important decisions on whether or not children are to be a part of their future. For others, pets can serve as a child 'substitute', offering people who choose not to have, or cannot conceive, children, an outlet for emotional attachment and nurturing behaviour."

The forecast formed part of the Association's response to the Environment Food and Rural Affairs Committee (EfraCom) inquiry into the impact on the UK’s trade in food after Brexit.
The BVA says that if the UK is treated as a 'third country' post Brexit, exports and imports of animals and animal products to and from the EU will need new veterinary certifications.
The UK Chief Veterinary Officer, Nigel Gibbens, says the volume of products requiring veterinary certifications could increase by as much as 325% as a result.
There are currently 1,063 Official Veterinarians authorised by the Government’s Animal and Plant Health Agency (APHA) to certify food products for export to third countries from Great Britain, a number which the BVA says would have to be significantly increased.
The BVA is urging the Government to undertake a major review of third country certification to ensure we have the capacity to fulfil new trade agreements. To combat the potential shortage in veterinary capacity, BVA is also calling on the Government to guarantee working rights for non-British EU vets and veterinary nurses currently working and studying in the UK.
British Veterinary Association Senior Vice President, Gudrun Ravetz said: "Vets are absolutely vital to facilitating UK trade by ensuring standards so that consumers at home and abroad have confidence in the food safety and welfare of the products they choose to buy. Veterinary certification is required not only for meat, but a whole range of products such as gelatine in sweets.
"Ironically, it is non-British EU vets who make up around 50% of our new workforce each year. However, since the EU referendum, we are facing serious problems in recruiting and retaining EU vets, which makes the need for more vets to perform this crucial trade-task an even more pressing concern. Vets’ role in the future of UK trade must be recognised and planned for, as an integral part of forthcoming trade negotiations."
The BVA trade submission also outlines that access to veterinary medicines could potentially be restricted post-Brexit. In order to protect animal and public health, BVA is calling for any new trade deal with the EU to maintain the link with EU veterinary medicine approval systems.
The UK currently has high standards of animal health, animal welfare and public health, including food safety, in its food production. These standards help prevent the spread of pathogens and diseases in animal products, ensure farm animals have a humane death, protect food safety and safeguard responsible antimicrobial use. BVA’s submission to the EfraCom trade inquiry emphasises that, as public goods, the UK must prioritise the maintenance of these standards in all trade negotiations moving forwards.

Although the disease is commonly diagnosed later in life, a 2022 study of 123 dogs found that 40% of those aged between one and four years old had radiographic osteoarthritis, of which about half had clinical signs and of those only 2 were being treated for pain1.
Another 2022 study found that 38% of dogs over the age of one had osteoarthritic pain, but only half of them were presented for lameness or stiffness2.
Geoffrey Guyot, Pain and Inflammation Franchise Lead at Boehringer Ingelheim Animal Health, said: “Clinical signs of early osteoarthritis can be subtle.
"Some young dogs may present with overt lameness, but many compensate for years and manage to continue to perform their daily activities.
"Common compensations include gait or posture changes to unload the painful joint, which often go unnoticed.”
Boehringer says the aim of its campaign is to shift the perception of osteoarthritis as an old dog disease, to one which could affect dogs of all ages.
Boehringer also wants the campaign to bridge the gap between vets and dog owners, making it easier for owners to spot the early signs and initiate conversations about the condition.
Geoffrey added: "We hope the Arthritis AWARE campaign will raise awareness of early OA among owners to create more opportunities for you to diagnose and treat dogs with arthritis and improve their outcome.
"We encourage vet practices to join us on the journey so we can help improve dogs’ wellbeing together.”

The BetterwithPets Prize invites entries from entrepreneurs whose work focuses on the power of the pet human bond and whose efforts are helping to transform society. Purina runs the prize in collaboration with Ashoka, a pioneer in the field of social entrepreneurship.
StreetVet was shortlisted from 150 applicants from Europe, the Middle East and North Africa. Its Accredited Hostel Scheme offers free, accessible veterinary care for pets whose owners are experiencing homelessness and support for hostel managers and staff to adopt and implement positive pet policies.

Acepromazine-based Acecare is used alongside other opioids and reduces the amount of anaesthetic necessary to induce anaesthesia by approximately one third.

The first is the introduction of Specialist training and status for general practitioners in primary care, for which the RCVS project will now develop a new five-year curriculum and an implementation plan.
The RCVS will also be looking closer at the definition of veterinary clinical roles and developing guidance for the profession and wider public on the different clinical career statuses available to veterinary surgeons.
Thirdly, the College will identify different ways in which vets can access the teaching and learning opportunities, clinical experience/cases, supervision and support that is required for them to complete specialist training and obtain RCVS Specialist status.
This will include looking at how access to specialist training can be widened beyond the typical internship/residency model, to include training models more accessible from primary care practice, and for those at different career and life stages.
Kate Richards MRCVS, Chair of the RCVS Education Committee, said: “These exciting and progressive proposals are visionary as far as the career and development structure of the veterinary clinical profession is concerned.
“It means there will be new prospects for those in general practice and those who want to achieve Specialist status by different means, as well as a more defined career structure for the profession that will be clearer to the profession and general public alike.
"With around 75-80% of veterinary professionals working in clinical practice this project will deliver a substantial positive impact.
“These are the early pages of a very exciting new chapter for veterinary clinical careers, and we will be asking for your help to write it, as we will be holding a number of consultations in the coming years, including on the programme for Specialist in Primary Care and the definition of clinical roles.
RCVS President Dr Sue Paterson FRCVS added: “There are two aspects of the project that I particularly welcome.
"First is the impact this could have on both recruitment and retention as vets are offered additional, and more diversified, career options and expanded roles in a variety of clinical settings.
"Second, as a specialist dermatologist myself, I really value the fact that we will be looking at ways to widen participation and increase accessibility to specialist training from primary care practice, as the residency/internship route is very intensive and not necessarily suitable for everyone.
A similar process to develop and enhance clinical career pathways for veterinary nurses is now also being considered, this would include the development of an ‘Advanced Veterinary Nurse’ status and clearer information on the veterinary nursing role and what it entails.
Millpledge has launched Dermafuse Tissue Adhesive, an n-butyl cyanoacrylate medical adhesive used to bond tissue together following veterinary procedures.
Dermafuse contains a blue dye to help users see where product has been applied.
On contact with body tissue, Dermafuse changes from liquid to solid state by polymerizing within seconds to seal the wound.
Millpledge says the adhesive stops minor bleeding and binds wound edges, which may eliminate the need for sutures or bandages. In some instances it also acts as a barrier to keep foreign matter from entering the wound. The tissue adhesive is sloughed as healing occurs.
Each 3g bottle contains approximately 175 drops. Four sterile applicator tips are provided with each pack.
