Mr Kane was sentenced to two years’ imprisonment, suspended for 18 months in September 2024.
He was also disqualified from driving for two years until he had passed an extended driving test, and was ordered to undertake 200 hours of unpaid work within 12 months, and to pay a victim surcharge of £187.
It was alleged that the conviction rendered Mr Kane unfit to practise as a veterinary nurse.
From the outset, Mr Kane admitted the facts contained in the charge, but did not accept that this rendered him unfit to practise as a veterinary nurse.
After the criminal proceedings, Mr Kane wrote to express his deepest regret for his actions and the pain and guilt they had caused, stating that there was not a single day that had passed that he had not thought about the family that was affected by his actions, and the lifelong consequences that they now face.
He went on to express that he understood that as a member of a trusted profession, his conduct must reflect not only his clinical competence, but also his integrity and accountability.
He also noted that he had sought to recognise and address the consequences of his actions and that he is determined to make a positive contribution to society and to the profession.
The Committee found the charge proved on the basis of Mr Kane’s admission and the Certificate of Conviction.
The Committee found a number of factors relevant to the case:
The question for the Committee was whether Mr Kane’s conviction of causing serious injury by dangerous driving, when put into proper context, rendered him unfit to practise as a veterinary nurse.
This was not a conviction in any way linked to his practise and there was no suggestion that he represented any sort of a risk to animals in his care.
The Committee was not, therefore, concerned with any issues arising out of the need to protect animals, but rather with whether a finding of unfitness to practise was needed to uphold standards of conduct and behaviour in order to maintain public confidence in the profession.
Kathryn Peaty, Chair of the Committee and speaking on its behalf, said: “The Committee took into account the public interest which includes maintaining public confidence in the profession and the regulator and upholding proper standards in the profession.
"The public interest also includes allowing an otherwise competent veterinary nurse to continue in practice, where appropriate.
“Agreeing with the judge that this was indeed an exceptional case, the Committee did not consider that Mr Kane’s conduct was liable to have a seriously detrimental effect on the reputation of the profession and concluded that the public, in full knowledge of the circumstances of this particular case, would not expect a finding that the conviction renders him unfit to practise as a veterinary nurse.
"Rather, the public would recognise that whilst the consequences were appalling and tragic for the family involved, in terms of Mr Kane’s culpability this was a momentary piece of dangerous driving, categorised by the judge as a ‘mistake’ rather than anything more blameworthy.
“The Committee therefore concluded that Mr Kane’s conviction does not render him unfit to practise as a veterinary nurse.
"This is not to in any way detract from the catastrophic consequences for the family, but rather is to reflect the context, exceptional circumstances and level of culpability in this case.”

BEVA is giving its members the opportunity to participate in a free practice benchmarking survey, to help them ensure their business is being run as efficiently and profitably as possible. The results of the research will be released at BEVA Congress, 7th-10th September 2011.
The Association has worked with Hazlewoods, chartered accountants and business advisors to the veterinary profession, to develop a detailed benchmarking questionnaire for equine veterinary practices, which allows businesses to compare their practice, anonymously, with other similar practices. The report should identify areas for profit improvement, including practice structure and pricing and may also highlight other potential methods of income generation.
Mark Beaney, partner at Hazlewoods and specialist advisor to the veterinary profession, said: "This is a super opportunity for equine practices to obtain helpful, free advice on how to fine-tune their business for maximum efficiency, delivery and profit. In the study, Fluorescent tagging for environmental surface cleaning surveillance in a veterinary hospital 1, researchers at Ohio State University used a fluorescent dye to tag pre-determined surfaces in a large veterinary teaching hospital.
The dye was invisible to the naked eye, but fluoresced under a blacklight (UV-A source). It could be easily removed by regular cleaning.
Surfaces were tagged and then assessed 24 hours after tag placement to determine whether they had been cleaned. Tagging and assessment took place during non-peak hours in an attempt to eliminate observer bias. The study ran for a period of 5.5 weeks between June and July 2014 and a total of 4984 surfaces were tagged and assessed.
Jason Stull, corresponding author of the paper said: "Overall, 50% of surfaces were adequately cleaned so that the tag was completely removed. Cleaning varied widely by surface/object and hospital location. Of the surfaces designated as having primarily human contact, the equipment cart and door handle to the dog walking area were most frequently cleaned (100%), whilst examination equipment including the otoscope, ophthalmoscope and swivel light handle were the least frequently cleaned (2.3%).
"Of the surfaces designated as having primarily animal contact, the ward cage interior was the most frequently cleaned (89.0%) whilst the dog run interior was the least frequently cleaned (23.1%). In terms of hospital location, the most frequently cleaned area was radiology (77.5%) and the least frequently cleaned area was the small animal treatment area (4.2%)."
The overall proportion of surfaces satisfactorily cleaned was similar to that reported in previous studies, however, the findings for some surfaces and hospital areas differed.2 This demonstrates the importance of veterinary cleaning surveillance in individual practices so that targeted interventions can be implemented.
Nicholas Jeffery, editor of JSAP said: "With health-care associated infections being a persistent problem in human and veterinary medicine, it is important that surfaces and equipment within the veterinary practice are adequately cleaned. This research demonstrates the potential use of a commercial fluorescent dye for veterinary cleaning surveillance to inform hospital cleaning practices."

The company has set up the Group Veterinary Medical Board (GVMB) Research Fund to offer practical support and financial assistance.
Deputy Chief Medical Officer Alistair Cliff (pictured right), said: "We introduced funding for research across our European Group at the beginning of this year and have been overwhelmed by the interest this has received. We understand the importance of these opportunities for professional development and also an individual’s job satisfaction.
“We believe it is incumbent upon us to increase this support for research to contribute to the advancement of knowledge, the development of our teams and our value as an employer. Ensuring our teams are content, with a diverse range of ways to develop, is important in allowing us to continue to attract the best people in the profession.
The GVMB Research Fund made its first awards in June 2021. Seven grants were provided to research teams from three countries – the UK, The Netherlands and France. In total, the funding will benefit some 21 researchers working as interns, residents, referral clinicians and specialists from a variety of different settings.
Chief Medical Officer Amanda Boag said: "It is incredibly satisfying to be able to provide support to our teams at critical points of their professional development. In some cases, funding has been provided to experienced researchers looking to contribute yet more to the understanding within their respective disciplines. In other examples, we have supported interns, who are at the very beginning of that journey and at a stage where funding can be difficult to secure.”
She added: “With additional interest from several general practitioners and nurses, the fund has quickly become a significant benefit to working for IVC Evidensia."
The GVMB also provides resources to guide teams on study design, ethical requirements, and statistical support. Less experienced researchers can access a network of Research Partners - a group of experienced clinicians from around Europe who have volunteered their own time to mentor colleagues through a collaborative approach to a project.
The resources comprise guidance materials, a health and wellbeing assessment, associate case studies, links to external support and information posters.
The company is also piloting a mindfulness app called Headspace, which is now freely available to everyone at Linnaeus, whether they are experiencing the menopause or have other needs.

"Last year we launched a policy to provide special paid leave for pregnancy loss.
"But since implementing this we have noticed a gap.
"We felt our managers needed guidance and support on how to provide the more practical and emotional support on a day-to-day basis, if someone in their team experienced a loss."
The new guidance contains advice on how to understand each individual’s experiences and needs, help in the immediate situation of pregnancy loss at work, treat and record any time off directly related to a loss, understand how pregnancy loss can affect mental health, talk about pregnancy loss, facilitate a return to work and the importance of regular follow-ups and check-ins.
Each 'Facing Up To Finances' discussion will include tips from a financial professional and live Q&A from the community.
Hosted by a member of VetYou, the panel will include a financial professional, a guest sharing their experience, and a member of the Veterinary Woman team.

Zoetis has announced that it has upscaled production of Apoquel, the oral therapy for the treatment of canine pruritus, and it is now available to all UK vet practices on unlimited distribution.
The company says that there was unprecedented demand for Apoquel following its launch last year, so it had to introduce an allocation system to ensure that those dogs that had started on the product were able to remain on it for as long as their vet deemed appropriate.
During this time, Zoetis focused on strengthening its manufacturing capacity to make the product more widely available.
Apoquel is the first Janus Kinase (JAK) inhibitor approved for veterinary use. Zoetis says it provides rapid and sustained relief of pruritus and improves skin lesions. Its novel mechanism of action on the JAK enzyme is specifically designed to target the pruritogenic and pro-inflammatory pathways involved in the itch cycle. This, says the company, allows effective reduction of allergic itch regardless of its cause as well as improvement of skin lesions associated with allergic skin diseases and atopic dermatitis.

The guidelines, which have produced by a panel of clinicians and analgesia researchers, summarise the current evidence and offer expert opinion and best practice recommendations for the use of analgesics for common scenarios.

The company says the main breakthrough in this new authorisation is that the dose for cattle has been reduced from 4 ml to 2 ml, improving convenience and aligning with the latest regulatory data.
In cattle, the vaccine is indicated for active immunisation to reduce viraemia caused by BTV-3.
The onset of immunity is 3 weeks after completing the primary vaccination course.
The vaccine can be given to cattle from 2 months of age in naïve animals, or from 3 months if born to immune dams.
For the primary vaccination, two doses of 2ml are given, 3 weeks apart, intramuscularly.
In sheep, the vaccine is indicated for active immunisation to reduce viraemia, mortality, clinical signs and lesions caused by BTV-3.
The onset of immunity is 4 weeks after completing the primary vaccination course.
The vaccine can be given to sheep from 3 months of age, subcutaneously.
For the primary vaccination, one dose of 2 ml is given.

Denise Coston of Castle Veterinary Surgeons in Durham has won The Veterinary Business Journal Practice Manager of the Year 2011, and praised the award for promoting her role.
Denise, who was a manager at Lloyds TSB's lending centre and previously ran her own business, before joining Castle Vets three years ago, said: "I did not find out that I had been nominated until three weeks before the ceremony - it was totally out of the blue. To make it to the final three was brilliant, but to win was just incredible.
Denise also said the Practice Manager of the Year Award plays a vital part in promoting the role of practice managers to the wider industry: "It is so important in recognising and championing the efforts of practice managers. I'm sure there will be many people out there who still don't know what we do or how we could benefit their business and this award highlights our achievements.

The Animal Health Trust's (AHT) Dr Sue Dyson has been awarded a place in the International Equine Veterinarians Hall of Fame, in recognition of her contribution to hoof care in horses.
Sue, who is Head of Clinical Orthopaedics at the AHT, has lectured internationally and is known for both her clinical work with horses and an extensive research record, having published more than 200 refereed papers on lameness and diagnostic imaging in scientific journals. She has also co-authored several veterinary textbooks as well as training and competing as a high-level rider in international events.
Established in 1997, the International Equine Veterinarians Hall of Fame honours veterinary surgeons who have contributed to the knowledge and recognition of proper hoof care for horses. Vets are nominated either as practicing equine vets who work closely with farriers in the field, or as college and industry vets involved in teaching, research or other important aspects of equine veterinary and hoof care.
Anyone can nominate an equine vet for the award, which is sponsored by the American Farriers Journal, but selection is completed by previous inductees into the International Equine Veterinarians Hall of Fame. Awards are presented each year during the International Hoof-Care Summit in Cincinnati, Ohio.
Sue said: "I was completely surprised, but absolutely thrilled, to learn that I had been selected to join the distinguished list of people who have previously been appointed to the International Equine Veterinarians Hall of Fame.
"I think it is very humbling to recognise that, despite the knowledge that my team and I have amassed in the last 30 years, there is so much more to learn. From every new finding come many more questions. I hope that the enthusiastic dedication of my team will continue to result in learning and discovering more, and inspire others to do likewise, to the ultimate benefit of the welfare of our great friend, the horse."
Sue has has worked at the AHT for 30 years and is currently researching the association between hindlimb lameness and saddle slip. She has observed some association between the two for several years, however saddle slip has traditionally been attributed to an ill-fitting saddle, asymmetry of the horse's back shape or a crooked rider.
In 2011 Sue carried out a prospective research project with Intern Line Greve: 'Saddle slip may be an indicator of the presence of hindlimb lameness'. It was presented at the 51st Annual Congress of the British Equine Veterinary Association, Birmingham 2012, and identified that in some cases, saddle slip was directly linked to the presence of hindlimb lameness.
Research results showed that of 128 horses assessed for lameness grade and degree of saddle slip when ridden by two riders, the saddle consistently slipped to one side in 54% of the horses with hindlimb lameness, in comparison to just 4% of the horses with forelimb lameness. Diagnostic analgesia to abolish the hindlimb lameness eliminated the saddle slip in 97% of the horses observed in the study.
Sue and Line are currently undertaking further research to measure movement of the back, and forces under the saddle, with the aim of explaining biomechanically what is happening during the occurrence of saddle slip.
Eli Lilly and Company, which owns Elanco Animal Health, has announced an agreement to acquire Novartis Animal Health for approximately $5.4 billion in cash.
Lilly says that on completion of the deal, Elanco will be the second-largest animal health company in terms of global revenue. It will also solidify its number two ranking in the U.S., and improve its position in Europe and the rest of the world.
As part of the agreement, Lilly will acquire Novartis Animal Health's nine manufacturing sites, six dedicated research and development facilities, a global commercial infrastructure with a portfolio of approximately 600 products, a pipeline with more than 40 projects in development, and an experienced team of more than 3,000 employees.
The transaction is expected to be completed by the end of the first quarter of 2015, subject to clearance under the U.S. Hart-Scott-Rodino Antitrust Improvements Act, similar requirements outside the U.S., and other customary closing conditions.

The PDSA has announced the start of its annual pet slimming competition, and revealed the 17 competitors who will be fighting to win the title of Pet Fit Club Slimmer Of The Year.
The competition is run to highlight the high level of pet obesity in the UK. According to the charity, around a third of all dogs (2.5M) and a quarter of all cats (2M) are estimated to be overweight.
PDSA research has shown that 87% of owners give their pets treats, despite the fact that 91% realise the resulting obesity can reduce their pet's lifespan. The PDSA's PAW Report, produced in conjunction with YouGov, discovered that a wide range of inappropriate treats are being fed to pets, including fast food, leftovers, crisps, biscuits, chocolate and chips.
Elaine Pendlebury, PDSA Senior Veterinary Surgeon, said: "Obesity is one of the biggest welfare issues affecting pets in the UK today. Sadly, it also means millions of pets are at risk from potentially life-threatening health problems related to obesity."

Purina is inviting practices to participate in its inaugural UK Feline Dental Health Month, which starts on 1st July 2014.

Purina says Feline Dental Health Month has been created to help practices educate cat-owning clients about the importance of dental health. As many cat owners are unable or unwilling to check their cat's mouth and teeth due to the discreet nature of their pet, they rely on their vet to highlight potential problems. Feline dental disease is estimated to affect around three quarters of cats over the age of three, making it the most prevalent health condition seen amongst pet cats. Often painful and with the capability to cause systemic problems, dental problems in cats can represent a serious welfare problem if left untreated.
To help practices promote Feline Dental Health Month to their clients, Purina has prepared a support pack which includes waiting room promotional materials and client care leaflets with money off coupons. Practices will also be given a step-by-step publicity plan so they can promote the month in their local media and via their existing communications channels.
Purina says that signing up to the Feline Dental Health Month will mean that practices benefit from more contact with a client group that is potentially less engaged with their pet's health and also attract new clients via the promotional activity. This will provide an increase in opportunities to discuss other common health concerns with their clients and offer the potential to boost sales of products and services.

Of the seven awards, two are dedicated to recognising veterinary surgeons and nurses who go beyond the call of duty to better the lives of animals: the Chris Laurence Vet of the Year and the Welfare Nurse of the Year.
The winners are decided by a panel of judges including Christopher Laurence MBE BVSc and James Yeates, chief veterinarian at RSPCA. This year’s winners and runners up will be honoured at a ceremony taking place on the eve of BSAVA Congress on 5th April 2017.

The practice was officially opened by the TV presenter and newspaper columnist, Adrian Chiles, who faced a lot of criticism from the profession a couple of years ago when he wrote an article about increasing veterinary fees and upselling tactics.
Adrian said: “I have never received such a volume of correspondence to one of my newspaper columns.
"One of the people that wrote to me was Movement Director, Professor John Innes, and we had very useful subsequent discussions that made me realise I had unfairly blamed vets for the issues I had felt as a pet owner.”
The new centre is led by Mark Lowrie, Specialist veterinary neurologist, who is joined by orthopaedic surgeons, Kinley Smith and David Thomson and neurology residents, Callum Golding and Rebecca Clark.

The RSPCA has reported that 11,586 animals were abandoned last year. That's more than 30 a day, and an increase of over 57% compared to the 7,347 animals that were abandoned in 2007.
Is this a precursor for tough times for the veterinary profession? Difficult to know. It conflicts with the record profits announced by CVS only a month ago. And perhaps the sort of people that would consider abandoning their animal under any circumstances are not likely to have been regular visitors to a vet in the first place.
As of the start of this week, police forces and local authorities have new legal powers designed to reduce the number of dog attacks.
For the first time, police and local authorities will be able to demand that owners take action to prevent a dog attack or risk fine of up to £20,000. If a complaint has been made about a dog to the council or police, its owners can be ordered to do any or all of the following:
The government has published a manual called Dealing with irresponsible dog ownership: practitioner's manual, to guide police forces and local authorities in the use of their new legal powers to prevent dog attacks.
Animal Welfare Minister Lord de Mauley said: "Dog attacks are devastating for victims and their families which is why we are taking tough action against those who allow them to happen. Police and local authorities will now have more powers to demand that irresponsible dog owners take steps to prevent attacks before they occur. This is on top of the tougher prison sentences we introduced earlier this year for owners who allow their dogs to attack people and assistance dogs."
The National Policing Lead for Dangerous Dogs, DCC Gareth Pritchard said: "The Practitioners Manual gives police officers and other practitioners clear guidance on how to best implement the legislative changes, especially the early preventative measures such as Community Protection Notices, to help prevent more serious events occurring in the future. It also provides a platform to share good practice between police forces and partner agencies and it will form part of the ongoing training of Dog Legislation Officers across England and Wales."
