Last year saw the highest ever increase in the number of people enrolling as veterinary nursing (VN) students on vocational courses, according to figures released by the Royal College of Veterinary Surgeons.
In 2011, some 1,041 students registered with the RCVS to pursue vocational VN qualifications, compared with 809 in 2010 - a 29% increase.
The total number of people enrolling as student veterinary nurses on either vocational or degree courses in 2011 was 1,439, compared with 1,083 the preceding year - an overall increase of a third.
Libby Earle, head of the RCVS VN Department said: "The overall increase could partially be explained by degree students seeking to avoid increased university tuition fees. However, although there is a noticeable increase in enrolments linked to higher educational courses, this does not explain the increase in further education students.
"A more significant factor is likely to be the inception of the Level 3 Diploma, as this can be undertaken as a full-time programme," Libby continued. "As Colleges running such programmes arrange the practical training placements for their students, this opens up opportunities for the considerable number of people who want to become VNs but who are not employed by a training practice. When we introduced the qualification in 2010 we hoped that this would help to increase the number of VN students - so it's great to see this is happening already and with such a marked increase."

The RCVS is reminding veterinary surgeons and nurses that there is one week left till the deadline for nominations for the 2012 RCVS and RCVS VN Council elections.
Nominations must be made in writing on the prescribed form and received by the RCVS on or before 31 January 2012.
Prospective candidates need to provide the signatures and registered/listed addresses of two proposers, and should also submit a short biography, manifesto and photograph for inclusion in the RCVS News Extra election specials.
Nobody may nominate more than one candidate, and no current member of the RCVS Council or VN Council may make a nomination.

The RCVS Charitable Trust Library is marking National Libraries Day (4 February) with an open day and prize draws for library users.
The Library is inviting all vets and veterinary nurses - and librarians, staff and students from veterinary schools, other Royal Colleges and university medical schools - to an open day on Friday, 3 February. Free workshops on how to use and search the bibliographic databases will be run by Trust librarians, and those visiting can sign up for a free three-day trial membership. Refreshments will also be provided.
On National Libraries Day, every member of the RCVS Charitable Trust Library will be entered automatically into a draw to win a free 12-month extension to their library membership. Anyone who uses the Trust's Library services between 30 January and 10 February will also be entered into a separate draw for a chance to win a £50 voucher for Trust Library services.

The RCVS Disciplinary Committee has suspended a Co. Tyrone veterinary surgeon from the Register for ten months, having found him guilty of serious professional misconduct relating to three convictions for contravening animal export regulations.
Whilst working as an Authorised Veterinary Inspector in Castlederg for the Department of Agriculture and Rural Development (DARD), William Manson had falsely certified that he had inspected three consignments of sheep presented for assembly at Plumbridge Export Assembly Centre on 16 and 23 August 2009. At this week's two-day hearing, Mr Manson admitted that the convictions he had received at the Strabane Magistrates Court on 26 November 2010 made him unfit to practise veterinary surgery, but said in mitigation that he had examined the sheep nearby at Landahussy, a site he considered more suitable for a large number of animals.
The Committee was satisfied that Mr Manson believed the Landahussy site to be more suitable for large deliveries; the Committee also was satisfied that he did carry out a visual inspection of the sheep at the Landahussy site on 16 and 23 August 2009. However, the information Mr Manson provided on the three certificates was false and misleading. Mr Manson had also been reminded of the importance of complying with government regulations in a disciplinary case in 2004, following convictions for failing to notify DARD about changes in the number of sheep for which he was claiming a premium. The then Committee dismissed the case, deeming the convictions a result of his "genuine but regrettable oversight".
Speaking on behalf of the Committee, Chairman, Prof Peter Lees said: "Mr Manson's actions in certifying that he had examined the sheep at an approved assembly centre when he had not done so amounted to a serious departure from professional standards. If there had been a disease outbreak on either the Plumbridge or Landahussy site, such actions would have rendered contact tracings unreliable and inaccurate."
In mitigation, the Committee accepted medical evidence and Mr Manson's testimony that he was at that time under exceptional stress. He was working long hours in difficult circumstances without an assistant, and was under considerable personal pressure as a result of his wife's serious illness. It also took into account his age (66), exceptional testimonials produced on his behalf, and the impact on the community he served.
Prof Lees said: "The Committee has concluded that the removal of Mr Manson's name from the Register is neither proportionate nor necessary in the public interest nor to protect the welfare of animals. A proportionate sanction in this case is to suspend Mr Manson's name from the Register for a period of ten months."
Defra has launched a public consultation on proposals that would enable the RCVS to reconstitute its disciplinary committees independently of the RCVS Council, to ensure that the same group of people are not responsible for setting the rules, investigating complaints and hearing cases. The Royal College is urging the profession to support the proposals.
The proposed changes will be made by a Legislative Reform Order that will amend a specific part of the Veterinary Surgeons Act 1966, to require the RCVS Preliminary Investigation and Disciplinary Committees to be made up of veterinary surgeons and lay members who are not RCVS Council members, and who are appointed at arm's-length.
RCVS President, Dr. Jerry Davies said: "I am delighted that Defra is consulting on these long-anticipated proposals, which would allow the RCVS to deliver better, fairer and more effective regulation. I would urge members of the profession and the public to respond to this important consultation and to support the changes."
Under the proposals, following a transitional period, the Committees would cease to include Council members. The bodies which consider allegations of misconduct on the part of veterinary surgeons would thus be independently constituted and detached from policy discussions. The proposals would also improve the independence of the disciplinary processes by formally bringing lay people into the relevant Committees.
In addition, the College says that changes would increase the pool of people available to investigate complaints and sit on disciplinary hearings, thus allowing the case-load to be handled more efficiently, and ensuring that complaints are heard swiftly.

RCVS President Jerry Davies has apologised to the profession for its overspend on IT and development works at Belgravia House.
In fact, the apology was made to a meeting of BVA Council back on 7th December. VetSurgeon.org understands the College thought the apology would be widely promulgated shortly thereafter, and only later realised that this hadn't happened.
As a result, the College has now decided to publish Dr Davies' presentation in full.
At the meeting, Dr Davies set out more background about the two RCVS projects under review, explained the decisions taken at the time and the finances involved.
He also described how Professor McKelvey's recommendations were being actioned, alongside those of the College's Governance Review Group which were already underway.
Dr Davies reiterated that the College had always intended to publish the report in full, but that external legal Counsel had advised that to do so would be unlawful under the Data Protection Act.
According to the College, it was not possible to redact the report to an acceptable extent, as the personal data in question were referred to throughout a large proportion of it.
However, Dr Davies did apologise to the profession, saying: "In closing, I would like to emphasise that I, as President of the RCVS, am sorry for what has happened, but I hope you will appreciate that steps are being taken, in particular the setting up of the Audit and Risk Committee, to strengthen governance within our College."
Gordon Hockey has been appointed Acting Registrar at the Royal College of Veterinary Surgeons.
He succeeds Jane Hern, who had been Registrar for 15 years before deciding to move on to pursue other interests.
Gordon, who is a qualified pharmacist and barrister, has been at the College for the last 13 years as Head of the Professional Conduct Department and Assistant Registrar.
Meanwhile, the College says it is giving consideration to the future scope of the Registrar and Secretary's roles, as the Officer team begins the recruitment process.
Eleanor Ferguson has taken over as Acting Head of the Professional Conduct Department.
The Privy Council has dismissed the appeal of a Lincolnshire veterinary surgeon against the RCVS Disciplinary Committee's decision to strike him off the Register in January 2011 for serious professional misconduct.
At a two-week Disciplinary Committee hearing in January, Joseph Lennox Holmes of Waltham Veterinary Clinic, Grimsby, was found to have advised on and undertaken surgical procedures without sufficient clinical grounds or consideration of alternative treatment options; failed to obtain the informed consent of his clients; undertaken procedures outside his area of competence; failed to refer or discuss the option of referral to a specialist; and, failed to provide his patients with adequate pain relief. These findings related to two separate complaints and a total of 31 charges, of which 28 were found to amount to serious professional misconduct.
The Appeal was heard by Baroness Hale, Lord Wilson and Lord Kerr on 1 November 2011, and their judgment was delivered on Tuesday by Lord Wilson.
There were two principal parts to Mr Holmes's appeal: firstly, that RCVS procedures for investigating and determining complaints were biased against him and infringed his human right to a fair hearing by an independent and impartial tribunal; and, secondly, a number of complaints about the DC's findings and conclusions.
According to the RCVS, their Lordships recognised that the College's regulatory framework was constrained by the existing Veterinary Surgeons Act and "support[ed] statutory reform so as to enable members of the disciplinary committees to be chosen from outside the council"; but, they were satisfied that the College had made "strenuous attempts" to ensure its disciplinary procedures were fair and in accordance with human rights legislation.
They also remarked that the College had made "elaborate efforts" to separate the membership and work of the three RCVS Committees that produce guidance, investigate complaints and adjudicate on complaints, respectively. Their Lordships considered that "a fair-minded and informed observer [having considered all the facts] would not conclude there was a real possibility that the DC was biased against Mr Holmes".
Their Lordships also dismissed all of the 'deficiencies' that Mr Holmes had sought to identify in the DC's findings and conclusions. They generally preferred the College's evidence, witness accounts and expert witness testimony, and felt the DC had correctly considered the multiple charges before it.
They also found that the expertise of the DC in assessing the standards of the profession was "entitled to substantial respect" and agreed that the only sanction appropriate to Mr Holmes' "catalogue of egregious misconduct" was the removal of his name from the Register.
"[This sanction] was the only disposal which could properly reflect the primary need to serve both the interests of animal welfare and the reputation of the veterinary profession," they concluded.
Their Lordships' decision is now subject to approval by the Crown, following which, Mr Holmes would be removed from the Register and no longer entitled to practise as a veterinary surgeon.
The Royal College of Veterinary Surgeons has refused to release the McKelvey Report in full, despite Freedom of Information requests made by VetSurgeon.org and others.
According to the College, it had always been the intention of RCVS Officers that the full report, which considered the building works in the Lower Ground Floor of the RCVS offices in Belgravia House, and the implementation of a new database, would be published.
However, on the advice of solicitors (Penningtons), only the recommendations of the Report were published initially, in November.
This publication followed discussion of the full report (one sentence was redacted on legal advice) by RCVS Council on 3 November.
Freedom of Information requests for the full report were then received by the College, so further, external senior legal advice was sought.
This advice, from Counsel, confirmed the original view from solicitors that it would be inappropriate to publish the report in full because it includes personal data, which ought not to be made public, under the Data Protection Act.
The College claims the meat of the report is in the recommendations, which account for approximately 50% of the report, and which are being taken forward by Officers and RCVS Council, with plans to put an Audit and Risk Committee in place taking priority.
The recommendations of the report, which were adopted by Council, were published online on 11 November and are available to download from the 'Related documents' box, above right.
The RCVS Charitable Trust has made two 'Blue Sky' grants of £20,000 each for research into feline rotavirus and equine gut bacteria.
One award has been made to Allison German and Kenton Morgan at the University of Liverpool as a Richard Daubney Research Fellowship. This will enable research to be undertaken into the molecular epidemiology and zoonotic potential of feline rotavirus in UK cats.
Allison said: "Feline rotaviruses have been identified in diarrhoeic children in Japan, Italy, Israel and America, but because of limited funding options, there has been no systematic study of rotaviruses in cats, so the prevalence, risk factors and zoonotic potential are unknown. I am pleased that the Trust has recognised the importance of emerging infectious diseases in companion animals and their potential role in animal and human health."
By assessing faecal samples from cats within Cats Protection Adoption Centres in the UK, the study aims to discover the prevalence of rotavirus in this cat population and broadly identify the strains of feline rotavirus that are circulating, including looking for any with identity to human strains. The study will also determine whether the molecular epidemiology of rotavirus in the cat population enables understanding of the diversification and evolution of rotaviruses in people.
A second Blue Sky award of £20,000 has been made to Chris Proudman and Alistair Darby, also at the University of Liverpool, to research the role of gut bacteria in horse health and disease. Called Metagenomic Analytical Utilities for Equines (MANURE), the project will sequence DNA from microbes taken from horse intestines, and analyse the diversity, composition and abundance of the microbial populations. This is expected to improve veterinary understanding of the role of equine gut bacteria, and benefit horses and their owners. Tools being developed to characterise and investigate equine gut microbiota, and findings expected, such as the discovery of novel bacteria, should also be useful to other research.
RCVS Trust Director Cherry Bushell said: "As usual, the standard of applications was very good, although we do continue to receive a relatively high number of applications for projects that the assessors judge to be more 'surveys' than genuine blue sky research.
"In deciding which research to fund, a number of factors are taken into account, such as the quality and strength of the research team, the likelihood of success, and whether a genuine gap in knowledge has been identified. For example, the feline rotavirus research could have important findings in the longer term if it is found that there is genuine risk to human health, and also shows clear potential for further study. Similarly, the equine gut bacteria study is likely to increase considerably knowledge over the longer term and to attract funding from elsewhere for further research."
A man who worked as a veterinary surgeon in Wiltshire, despite being neither qualified nor registered with RCVS, has received a 20-month sentence at Swindon Crown Court.
Peter Keniry (also known as Patrick Keniry), from Great Yarmouth, had been practising under the name of a properly qualified and legitimately registered veterinary surgeon, and was arrested on 23 August. At his initial hearing in Swindon Magistrates' Court, Mr Keniry pleaded guilty to charges of fraud by misrepresentation and unlawfully practising as a veterinary surgeon, and was released on bail.
At the Crown Court on Friday, Mr Keniry also pleaded guilty to additional charges before being sentenced. It is understood he will serve a number of months in prison, before being released on licence for the remaining period.
The RCVS assisted Wiltshire police in their apprehension of Keniry in August, having been alerted the previous day to his fraudulent activities. Mr Keniry is no stranger to the College or the police, having already been dealt with in 1998, 2001 and 2005 for similar offences. On each occasion, Mr Keniry has impersonated a member of the College whose name is legitimately on the Register, which makes it difficult even for practices that do check the credentials of prospective employees to pick up a problem.
Commenting on the recent sentencing, Gordon Hockey, RCVS Head of Professional Conduct said: "We are satisfied that the Court has clearly recognised the risk posed to both animal welfare and public safety by bogus veterinary surgeons. Anyone working as a veterinary surgeon when not qualified to do so, risks a custodial sentence.
"Mr Keniry's continued pattern of re-offending shows him to be a very convincing fraudster. By publicising his photograph, we hope to help any potential employer or locum agency reduce the chances of this happening again," he added.
The RCVS Disciplinary Committee has removed a veterinary surgeon formerly working in Lincolnshire from the Register, after finding him guilty of serious professional misconduct for drink-driving related convictions, failing to inform his employer of these convictions, and driving whilst disqualified.
Jaroslaw Slominski, a former employer of Grants Veterinary Services plc, chose not to attend the three-day hearing. The Committee considered whether to proceed with the case, using criteria identified by the Court of Appeal in R v Jones (Anthony) in 2002 and confirmed by the House of Lords. It concluded it was in the interests of justice that the hearing should go ahead.
The charges related to two convictions Mr Slominski received on 17 March 2010 at Lincoln Magistrates Court: failure to provide a specimen of breath for analysis and driving without due care and attention (after his vehicle collided head-on with another car). Mr Slominski failed to inform his employers of these convictions, as he was contractually obliged to do, and that he was now disqualified from driving.
Having heard evidence from Mr Slominski's line manager, the Committee also found that he had driven his employer's vehicle whilst disqualified, although it could not be sure that he had done so on all the occasions alleged. Therefore, the Committee did not go on to consider an alternative part of the charge - that Mr Slominski had dishonestly claimed money from his employer by falsely submitting expenses claims.
Disciplinary Committee Chairman Prof Peter Lees said: "The combination of factors in this case, namely, the serious nature of his conviction in failing to provide a specimen of breath, his subsequent premeditated conduct in not informing his employers and driving whilst disqualified should be treated by the profession very seriously. The Committee has concluded that the combination of the conviction and the conduct is incompatible with Mr Slominski practising as a veterinary surgeon."
The Committee directed that Mr Slominski's name be removed from the Register.
The Royal College of Veterinary Surgeons has produced bookmarks for accredited practices to give clients, which explain the RCVS Practice Standards Scheme (PSS).

The RCVS Charitable Trust has announced that it is working in partnership with Imperial College London and the Arts and Humanities Research Council (AHRC) to co-fund a doctorate entitled 'Veterinary training and veterinary work: a female perspective, 1919-2000.'
This will look at the shift in women's expectations, experiences, professional networks and career trajectories, and examine how and why certain veterinary activities came to be regarded as suitable (or unsuitable) work for women. In the course of this research the personal collections of two prominent members of the veterinary profession, Connie Ford and Olga Uvarov, will also be catalogued, to make these papers more accessible to both professional researchers and more generalist readers.
Clare Boulton, RCVS Charitable Trust Librarian and the Trust's project supervisor said: "This exciting project is an opportunity to really use the archival material held by the RCVS Charitable Trust Library, interview transcripts and surveys, to describe and analyse the educational and work experiences of successive generations of female British vets. It's great to be able to work with other academic institutions on a project of this nature so we can share expertise - and make the most of the research findings."
The research will be carried out by Julie Hipperson, who holds an MA in Modern History from King's College London, and whose interests include women in the professions in the twentieth century, and rural environments and communities. She said: "I hope new insights will be gained into the most famous of veterinary female pioneers.
"More than this, however, I will be looking at the mainstream of female vets, their aspirations, motivations and achievements since 1919, and also the obstacles they encountered, in order to contextualise the 'feminisation' of the profession. This is a sizeable challenge, but one which I hope will be invaluable not only to the veterinary profession, but also to understand more fully women in the professions throughout the twentieth century."

RCVS President, Dr Jerry Davies, has committed to prioritise the establishment of a new Audit and Risk Committee, following publication of the recommendations of a report into two overspends at the College.
Earlier this year, outgoing President Peter Jinman had announced that a review would be carried out into the circumstances that led to higher-than-expected expenditure on the College's new database and building development works in the Lower Ground Floor at Belgravia House.
The RCVS Officer team asked Professor Bill McKelvey - a member of the College's Governance Review Group - and two of the College's Privy Council-appointed Council members to look at all aspects that related to its budgeting and expenditure process of those projects, and propose lessons that should be learned.
Dr Davies said: "That such a review was required is regretted, but I would like to thank Professor McKelvey, Richard Davis and Judith Webb for their diligence in this work. Their recommendations will be a very helpful addition to the work that is currently underway to ensure corporate governance is fit for purpose and, in particular, that the management of capital projects within the College is optimised."
The full Overspend Report (one sentence was redacted on legal advice) was considered by Council at its meeting on 3 November. Council agreed that the recommendations should be made public. The College is currently seeking further legal advice on whether it is proper for the report to be made available under the Freedom of Information Act.
Dr Davies added: "The recommendations of the report are under consideration by a group of five past Presidents, together with Richard Davis and Judith Webb as lay members of Council, under the Chairmanship of Peter Jinman, and their proposals will be considered by Council in due course.
"The recommendation that an Audit and Risk Committee be set up will be prioritised, as this was highlighted as an imperative. Other related activities, such as the development of a protocol for the management of major projects, had already been put in place by Officers prior to the overspend review."
Regarding the two projects at the heart of the report, the College says building work in the Lower Ground Floor at Belgravia House has been complete for some time and the new rooms and their facilities are being used, particularly when Disciplinary Committee hearings render much of the rest of the building out of bounds. The new data management system is also in use and an external consultant is currently looking at the work that has been carried out so far, and will make recommendations for the future.
"Meanwhile, although there are many lessons to be learned from the report, it's business as usual in terms of bringing to a conclusion many of our important ongoing initiatives, such as the introduction of the new Code of Professional Conduct, the consultations on the recommendations of the Specialisation Working Party and a draft Performance Protocol, and, of course, the ongoing work of the Disciplinary and Preliminary Investigation Committees," said Dr Davies.

The RCVS Disciplinary Committee has reprimanded and warned as to his future conduct a Hampshire veterinary surgeon found guilty of serious professional misconduct for cumulative failures to provide adequate professional care, and insufficient regard for animal welfare whilst treating a dog that had ingested broken glass.
The sanction was decided following a 12-month postponement of a decision ordered at a hearing on 19 November 2010.
At last week's hearing, the Committee was asked to decide what sanction would be appropriate in the case of Peter Ardle MacMahon for his treatment of a Cocker Spaniel called Wilfred, while working as a locum in Portsmouth. In 2010, the Committee found that Mr MacMahon had not removed the ingested glass from Wilfred's stomach or adequately checked that he had done so; had inadequately prevented abdominal contamination; and, had failed to communicate this contamination problem to Wilfred's usual veterinary surgeon. Considering these charges cumulatively, the Committee found that the treatment Mr MacMahon provided to Wilfred had fallen far short of the standard to be expected in the profession and amounted to serious professional misconduct.
Shortly prior to treating Wilfred, Mr MacMahon had returned to practice after a ten-year absence and, at last year's hearing, agreed to comply with undertakings regarding his professional development. These included performing at least 70 hours of medical and surgical continuing professional development (CPD); providing the Disciplinary Committee Chairman with quarterly CPD reports and two employer reports regarding his competence; observing 24 days of current practice by shadowing another veterinary surgeon; and, providing reports from this veterinary surgeon as to his competence and a case diary.
The Committee considered the factual findings from the November 2010 hearing and the concerns then expressed about Mr MacMahon's conduct and capabilities as a veterinary surgeon, as well as his compliance with the agreed undertakings. As advised by the Legal Assessor, the Committee's considerations of sanction began at the lowest level that would ensure that the welfare of animals was properly protected; that proper standards would be maintained among practitioners in the profession; and, that would be in the interests of the public.
Speaking on behalf of the Disciplinary Committee, Chairman Professor Peter Lees said: "The Committee is satisfied that the respondent had complied fully with the spirit of the requirements of the undertakings he had entered into on 18 November 2010. Indeed, the view is that the respondent has done well to achieve the level of compliance that he has, given that he had suffered a period of significant ill-health during the period since he entered into those undertakings.
"The ultimate decision is that the respondent's conduct [...] warrants the imposition of at least a reprimand," he continued. "However, it is also the Committee's firm view that the respondent must be warned about his future conduct so that he will know the Committee considers he needs to maintain the level of continuous professional development that he has achieved [over the last] 12 months, and to have constantly in mind the paramount obligation of all veterinary surgeons to ensure the welfare of animals under their care.
"Such a warning as to future conduct should, and the Committee believes that it will, serve as a constant reminder to the respondent that he must undertake only those procedures, and only proffer professional advice, in the areas where he has the requisite up-to-date skills, knowledge and experience."
The Committee reprimanded Mr MacMahon and warned him as to his future conduct.
The RCVS Disciplinary Committee has dismissed a case against a Nottinghamshire veterinary surgeon, having found not proven the charge that he had caused, allowed or failed to prevent a potential breach of the Rules of Racing of the Greyhound Board of Great Britain (GBGB).
During the re-scheduled, three-day hearing, the Committee heard that Dr Gary Samuel was on duty on 10 October 2009 as the GBGB licensed track veterinary surgeon at Nottingham Greyhound Stadium. When the trainer came to collect her dog for the race, she discovered a biscuit in his kennel in the paddock area, in potential contravention of the rules of the GBGB, which do not allow greyhounds access to any food, drink or other substance after weighing in, prior to a race. She reported this discovery to the paddock steward. The dog was withdrawn from the race, so there was no prospect of prize money. The trainer, despite her unblemished record, was put at risk of disciplinary action by the GBGB, which could have resulted in the loss of her training licence and livelihood. Following the events of 10 October, the GBGB held a disciplinary hearing, at which Dr Samuel was disqualified indefinitely from holding a GBGB licence and fined £2,500, and the matter was referred to the College.
The RCVS Disciplinary Committee confirmed that it should not be bound by the GBGB decision, and that the charges laid against Dr Samuel must be resolved on the basis of the evidence before it. Both Counsel for Dr Samuel and the College urged the Committee to have close regard of CCTV footage from 10 October, which showed Kennel 21 where the dog had been placed and the biscuit found. From evidence given by the paddock steward and the trainer, the Committee accepted that the kennel was clean when the dog entered at 5.30pm, so the biscuit must have been introduced between 5.30pm and 9pm, when the trainer collected him for the race.
The footage available to the Committee from Nottingham Race Track was only four-and-a-half minutes long. The Committee was concerned that there were almost three-and-a-half hours of footage that it had not been shown and that, in addition, witnesses were not able to state that they had viewed the remainder of the footage. In those circumstances, the Committee considered that the footage available must be of the best quality to allow it to reach a sure conclusion as to what exactly Dr Samuel may have been doing in his position close to Kennel 21. From the quality of the footage available, the Committee was not able to be sure.
Speaking on behalf of the Disciplinary Committee, Vice-Chairman Professor Sheila Crispin said: "The fact remains that the Committee cannot be sure that the Respondent caused the biscuit to enter Kennel 21, [so] finds the charge against the Respondent not proved."
Dr Samuel therefore remains on the RCVS Register and is entitled to practise.
The RCVS has published the conclusions of The McKelvey Report, a review into the circumstances leading to a substantial overspend on the College's new database and development works at Belgravia House.
The review was carried out by Professor Bill McKelvey - a member of the College's Governance Review Group - and two of the College's Privy Council-appointed Council members to consider all aspects relating to the College's budgeting and expenditure process, and propose lessons that could be learned.
Whilst the full report has not yet been published, its conclusions highlight:

Weaknesses exist in the governance of the RCVS which pose significant risks to the proper conduct of its business. Executive staff have not been provided with a robust governance framework by the Council, and this has led to a number of unnecessary misunderstandings between Executive staff and Non Executive members of Council. These matters should be urgently addressed by Council in order to ensure that the confidence of ordinary members of the profession in their College can be restored.
Dr Jerry Davies, RCVS President said: "That such a review was required is regretted, but I would like to thank Professor McKelvey, Richard Davis and Judith Webb for their diligence in this work. Their recommendations will be a very helpful addition to the work that is currently underway to ensure corporate governance is fit for purpose and, in particular, that the management of capital projects within the College is optimised."

The Royal College of Veterinary Surgeons is calling for comment on a draft Performance Protocol, which aims to manage proportionately any justified concerns about the professional performance of veterinary surgeons and registered veterinary nurses.
The RCVS's Preliminary Investigation and Advisory Committees have been working together to develop a new protocol setting out the way in which the College will respond to ongoing performance-related concerns. There is an expectation that veterinary surgeons and RVNs are already regularly reviewing their clinical work in the workplace. This will be reinforced by the new principles-based Code of Professional Conduct, currently being finalised, which is likely to require clinical governance to be part of professional practice for veterinary surgeons and RVNs.
According to the College, the draft protocol is intended to formalise and build on the way it already manages ongoing serious performance-related concerns. It introduces new measures, including supervision and undertakings, to seek to ensure that veterinary surgeons and RVNs take reasonable steps to address any serious performance concerns. This will bring the RCVS into line with other professional regulators and enable a tailored and proportionate response to these cases to protect the welfare of animals and the public interest. The College's current system of offering advice to veterinary surgeons and RVNs will remain for complaints which are closed, because there is no indication of serious professional misconduct.
The College says that according to independent legal advice, such an approach is appropriate and necessary in order for it to fulfil its regulatory responsibilities. The draft performance protocol follows similar legal advice that supported the implementation of the RCVS Health Protocol, and both protocols clarify the College's parallel jurisdiction relating to health and performance-related issues.
RCVS President Jerry Davies said: "When veterinary surgeons and registered veterinary nurses are unable to deal with performance-related concerns, it is important that we are able to provide a supportive framework to oversee remedial steps that are designed to address those concerns and encourage professional development. This is best achieved outside a Disciplinary Committee hearing, if at all possible".
The approved draft protocol is now open for public consultation, and may be found at www.rcvs.org.uk/performance. All comments on the draft should be emailed to Simon Wiklund, Advisory Manager at s.wiklund@rcvs.org.uk by 13 January 2012, with 'Performance Protocol' added to the subject heading.
The feedback received from the consultation will be considered by the Preliminary Investigation and Advisory Committees in January 2012, before being submitted to RCVS Council for approval in March.
The College says it hopes that a performance protocol will form part of the supporting guidance to the new RCVS Codes of Professional Conduct for both veterinary surgeons and registered veterinary nurses.
Veterinary surgeons and veterinary nurses will be able to try their hands at the Royal College of Veterinary Surgeons code-cracking competition at the London Vet Show at Olympia on 24-25 November.
At the RCVS breakfast session on the Friday morning (8.30, part of the Business Stream), President Dr Jerry Davies will unlock the secrets of the proposed new Codes of Professional Conduct for vets and VNs.
To promote this breakfast session, the RCVS is inviting visitors to come to its stand (J90) to solve photo enigmas, using clues provided to decipher a series of words that appear in the proposed new Codes. The winner will be in line to receive a pair of super sleuthing video glasses.
VNs who missed BVNA Congress can also get their hands on a 50th anniversary commemorative chocolate medallion by visiting the RCVS stand.
Coffee and pastries will be served at the morning session on Friday - there's no need to book, just turn up.
Nominations are now open for candidates wishing to stand in the 2012 RCVS Council and RCVS Veterinary Nurses Council elections.

Six seats on RCVS Council and two on VN Council are due to be filled in the 2012 elections. Those elected will take their seats on RCVS Day next July, to serve four-year terms, and will be expected to spend at least six to eight days a year attending Council meetings, working parties and subcommittees (a loss-of-earnings allowance is available).
All prospective candidates need to provide the signatures and registered/listed addresses of two proposers, and should also submit a short biography, manifesto and photograph for inclusion in the RCVS News Extra election specials. Nobody may nominate more than one candidate, and no current member of the RCVS Council or VN Council may make a nomination.
Nominations must be made in writing on the prescribed form and received by the Registrar on or before the closing date of 31 January 2012. Full details and guidance notes for both elections will be available on the RCVS website shortly on the RCVS Council Election page and VN Council Election page.

The Registrar and Secretary of the Royal College of Veterinary Surgeons, Jane Hern, has announced that she will be standing down at the end of the year.
After 15 years in the job, Jane says she has been pleased to oversee a number of significant reforms and new initiatives in her time leading the organisation, but has decided that it is time to move on and pursue other interests.
The College says it is now embarking on a comprehensive review of its governance, committee and management structures, during which the Officers and Council will consider how best the executive should be led in future.
Jane said: "I have greatly enjoyed my time with the College and the Trust. Working with a profession held in such high regard by the public has been a real pleasure. I wish veterinary surgeons, veterinary nurses and all my colleagues all the very best for the future."
The President, Dr Jerry Davies said: "The Royal College has been very fortunate in having the benefit of Jane's wisdom and guidance for so many years, and we wish her every success in the future."
The RCVS Veterinary Nurses Council has celebrated the 50th anniversary of veterinary nursing at the House of Commons with a call for statutory regulation for the profession.
At a Golden Jubilee event hosted by Mr Roger Gale MP, Veterinary Nurses Council Chairman Liz Branscombe drew attention to the fact that there is no legal protection for the title 'veterinary nurse', despite qualified nurses playing "a unique role in the practice team".
This effectively means that anyone could work in a veterinary practice as a nurse, without taking the three- or four-year training required for Listed or Registered Veterinary Nurses.
Liz said: "We believe that the nation's animals and their owners deserve better than this. And it's not just a question of animal welfare: public health is at risk from the incorrect use of medicines - for example, the well documented development of antimicrobial resistance."
The Veterinary Surgeons Act 1966 was put in place only five years after the introduction of veterinary nurse training and too soon to fully recognise the potential of veterinary nursing as a profession in its own right.
As an interim measure, the RCVS has put in place a non-statutory Register for Veterinary Nurses, to which 86% of eligible nurses have signed up. Registered Veterinary Nurses agree to follow a code of conduct, keep their skills and knowledge up to date and abide by a disciplinary system. However, it is not possible for the College to bar those removed from the Register for serious professional misconduct from working as a veterinary nurse.
The Register also does not address the misuse of the title 'veterinary nurse' by unqualified people.
Liz asked MPs present at the House of Commons reception to sign up to an Early Day Motion tabled by Andrew Rosindell MP, which calls for statutory regulation for the veterinary nursing profession.
Others are urged to sign a petition on the Government's website which has been mounted by the British Veterinary Nursing Association and is supported by the College and the British Veterinary Association: http://epetitions.direct.gov.uk/petitions/18700.
The issues are being considered by the RCVS Veterinary Nurses Legislation Working Party and the group's recommendations will feed into the wider work of the RCVS Legislation Working Party, which will be reporting to the Defra Minister of State in the summer of 2012 with proposals as to how statutory regulation could be provided for a range of veterinary services, including veterinary nursing.
The RCVS Veterinary Nurses Council has decided that the College should cease being an awarding body next year, which means it will no longer offer the vocational Level 3 Diploma in Veterinary Nursing.
The College says it will ensure that the Diploma continues to be available by transferring the intellectual property associated with the qualification, such as the question banks and systems, to another larger awarding body, in a move which is likely to take effect for the beginning of the 2012 academic year.
According to the College, this decision reflects recent changes in the regulatory Conditions of Approval for awarding bodies, which it would have been hard for the College to meet while continuing to offer the Diploma cost-effectively. The changes mainly relate to potential conflicts of interest between the College's primary role, as professional regulator that safeguards standards within the veterinary professions, and its role as an awarding body. The standards-setting role includes the regulation of education and training leading to the veterinary and VN registers, and it was felt that the College could no longer exercise this role effectively if it was also an awarding organisation, as it might be suspected of treating its internal qualifications more favourably, or of obstructing competitors.
Although the College says this has not been a problem in the past, the rules are now more stringent, and the costs of setting up a fully independent awarding body would be prohibitive.
The market for the Diploma is also likely to fragment in the future, with three other awarding bodies expressing an interest in offering a Level 3 Diploma. Any reduction in the number of students taking the RCVS Level 3 Diploma would further push up the costs, potentially making the RCVS Awarding Body unviable. A larger awarding body can take advantage of economies of scale across a range of awards in a way that the RCVS cannot.
Colonel Neil Smith, Chairman of the RCVS Awarding Body Board said: "The RCVS has been offering vocational qualifications since 1998 and the decision to cease being an awarding body has not been taken lightly.
"We have taken this decision in order to focus on our core responsibilities of professional regulation and standard setting. However, we remain committed to maintaining the Diploma, which has been carefully developed by the RCVS and the profession. This move ensures that it will stay in safe hands."
The name of the awarding body to which the qualification will be transferred has not yet been announced because the process is not complete. However, the College says it felt it was important to give those involved with the delivery of training as much notice as possible of the change. More information, and the change-over plan, will be released in due course.
Libby Earle, RCVS Head of Veterinary Nursing said: "Our priority will be effecting a smooth transfer for students, Colleges and training practices, and we are confident that the impact of the change will be minimal. Furthermore, it will be a condition of the transfer that the veterinary profession continues to have a say in the future development of the qualification."
Those students still in the process of completing the old NVQ qualifications, the accreditation of which is due to run out in 2013, will continue to be serviced by the RCVS.
As the professional regulator, the College will continue to issue RCVS certificates and badges to those who have successfully completed a registerable qualification - such as an approved vocational qualification run by another awarding body, or an RCVS-recognised veterinary nursing degree.
The Advanced Diploma in Veterinary Nursing will be unaffected by the change as the qualification is awarded by the College under its Royal Charter powers.
The RCVS has opened a consultation on the future of veterinary specialisation, which includes a proposal that the use of postnominals and titles by veterinary surgeons should be rationalised in order to avoid confusion amongst the public.
The proposals are submitted for comment by the RCVS Specialisation Working Party, which is chaired by former Chief Medical Officer Professor Sir Kenneth Calman.
The Working Party's review was precipitated by a finding that the structure of veterinary specialisation is "confusing and opaque" to both animal owners and the profession (Unlocking Potential - a Report on Veterinary Expertise in Food Animal Production, by Professor Philip Lowe, 2009).
The Working Party has explored the routes to RCVS Recognised Specialist status. It has also looked at the use of 'specialist' more broadly, given the fact that it is not a protected term in the veterinary field, and has considered animal owners' expectations of a 'specialist'.
The Working Party also makes proposals for encouraging more veterinary surgeons to become specialists, given that there are currently only 319 on the RCVS List of Recognised Specialists, out of a UK practising arm of the profession of some 17,400 veterinary surgeons.
The proposals from the Working Party could have far-reaching impact. One suggestion is that all those meeting the criteria for specialist status would also become Fellows of the RCVS (FRCVS) - a status currently only held by those who complete a thesis or exam, or who qualify on the basis of 'meritorious contributions to learning'. There are also proposals that the term 'RCVS Recognised Specialist' be dropped and replaced with the much simpler term 'specialist' or 'veterinary specialist'.
Further proposals include the introduction of a 'middle tier' of veterinary surgeons - potentially to be called 'advanced practitioners' - who would be below full specialist status and subject to periodic revalidation.
There are also recommendations that veterinary surgeons should be obliged to explain referral options to their clients, including the level of expertise of those to whom they are referring cases.
The future of the RCVS subject boards, which currently manage the various Certificate and Diploma examinations, is also considered in the proposals.
The emphasis throughout is on simplification and improvement, according to Professor Sir Kenneth Calman, who said: "New legislation to introduce statutory registration for veterinary specialists would no doubt make things clearer, as it is for doctors and dentists, but, in the meantime, we believe there are a number of actions which the RCVS could take to improve matters."
