&lt;p&gt;When it is clear that your actions were not, to continue to defend yourself nonetheless shows a lack of insight, a lack of appreciation of what you may have done better, and therefore no guarantee that you could do things differently in future - which by definition gives the DC a very straightforward case.&lt;/p&gt;
&lt;p&gt;It may help to think of any normal court - where someone commits a crime but is unapologetic and tries to defend themselves in the face of overwhelming evidence, they simply come out looking worse.&lt;/p&gt;
